Indivīda tiesību regulējuma palielināšanās kā modernisma vērtību dekonstrukcijas izpausme mūsdienu Eiropā

Abstract

Maģistra darbā analizētas indivīda un leģitīmās varas attiecības mūsdienu Eiropas kultūras sistēmā, vērtējot to atbilstību modernisma un apgaismības principiem indivīda dzīvi reglamentējošo tiesību normu radīšanā. Darbā tiek skaidrota modernisma paradigma; aprakstītas mūsdienu Eiropā konstatējamās izmaiņas vērtību uzstādījumos indivīda un valsts attiecību veidošanā, kas racionāli neiekļaujas modernisma paradigmas laukā un izraisa indivīda tiesību samazinājumu un valsts tiesību pieaugumu; kā arī sniegts iespējamo cēloņu skaidrojums, kas ir pamatā šādai vērtību maiņai. Darbā tiek noskaidrots, ka indivīda un valsts varas attiecības mūsdienās vairs nav iespējams leģitimēt apgaismības uzstādījumu ietvaros.

The research subject of the thesis is the legitimate relationship between the individual and state authority in contemporary Europe. The named relationship is analyzed evaluating its compliance with the individual rights principles of the modern paradigm and the Age of Enlightenment. The research focuses on explaining the term modernity and the modern thinking; it analyzes the changes in the perception of values used to form individual rights regulation, which do not comply with the Enlightenment principles; and provides the possible explanation of the changes in the individual rights regulation. The research concludes that the ongoing relationship between the individual and state authority cannot be legitimated by the philosophical discourse of modernity and the Age of Enlightenment.
