Fotoradaru ieviešana Latvijā- tiesiskā regulējuma problēmu analīze

Abstract

Ceļu satiksmes noteikumu ievērošana nepieciešama satiksmes drošības nodrošināšanā, savukārt, satiksmes drošība ir neatņemama kopējās sabiedrības drošības sastāvdaļa. Lai nodrošinātu satiksmes drošības uzlabošanos, nepieciešams veikt efektīvu braukšanas ātruma kontroli. Maģistra darbā analizētas braukšanas ātruma kontroles metodes, to efektivitāte un lietderība. Viena no braukšanas ātruma kontroles metodēm ir automātisko ātruma mērīšanas iekārtu izvietošana bīstamos ceļa posmos, kas mudina autovadītāju samazināt braukšanas ātrumu konkrētajā ceļa posmā, tādējādi to disciplinējot. Fotoradaru galvenais mērķis ir novērst atļautā braukšanas ātruma pārsniegšanu, kā rezultātā samazināsies arī ceļu satiksmes negadījumu skaits. Maģistra darba ietvaros ir analizēts Latvijā spēkā esošais normatīvais regulējums fotoradaru darbības jomā, atklātas tā problēmas un piedāvāti iespējamie risinājumi, kā maksimāli efektivizēt fotoradaru darbību, neaizskarot indivīda tiesības un sabiedrības intereses. Tāpat maģistra darbā tiek analizēta administratīvo sodu sistēma par atļautā braukšanas ātruma pārkāpumu, kā arī administratīvā pārkāpuma protokola-lēmuma pārsūdzības iespējas un ar to saistītās problēmas.

Compliance with the road traffic regulations is necessary to ensure and provide safety on the roads, while safety is an integral part of the overall public safety. In order to ensure the improvement of road safety, it is necessary to carry out an effective driving speed control. Master thesis analyzes the speed control methods, their effectiveness and efficiency. Placement of automatic speed measuring equipment on dangerous roads is one of the driving speed control methods encouraging drivers to reduce speed on the concrete part of the road thus disciplining them. The main objective of traffic enforcement cameras is to avoid speeding, which has to result in reduction of the number of accidents on roads. Master thesis analyzes the standing normative regulations in Latvia in the sphere of traffic enforcement cameras, reveals the problems and offers possible solutions to improve the effectiveness of the traffic enforcement cameras without violation of the rights of individuals and the public interest. Master thesis analyzes also the administrative penalty system regarding delict of speed, as well as the possibility to appeal an administrative delict protocol – decision and related difficulties.
