Abstract

Maģistra darbā „Tiesas paziņojumi, izsaukumi un tiesas dokumentu piegādāšana un izsniegšana” pētīta tiesas dokumentu, tai skaitā, to formas un satura problemātika un problēmas tiesas dokumentu izsniegšanā un piegādāšanā, ievērojot attiecīgā jautājuma nozīmi personu tiesību uz informāciju un tiesību uz savu interešu atbilstošu aizsardzību tiesā ieskatā, tiesas procesa efektivitātes un ātruma nodrošināšanā un praksē pastāvošās problēmas. Aplūkotā temata aktualitāte norāda uz nepieciešamību vērtēt līdz šim veiktās izmaiņas un risināt vēl joprojām pastāvošos un jaunus šīs jomas trūkumus, kas skar tādu jomas problemātiku, kas saistīta ar elektronisko, audio un citu formu, tiesas spriedumu garuma ietekmi uz tiesas noslogotību, paziņošanas un informētības sasaisti, pavēstu izsniegšanas precīzāku noregulēšanu, un daudzus citus nozīmīgus aspektus. Maģistra darbs sastāv no trīs nodaļām, pirmkārt, tiesas dokumentu un to izsniegšanas nozīmes civilprocesā, otrkārt, tiesas dokumentu problemātikas, proti, tiesas dokumentu būtības analīzes, to formas un satura analīzes, un, treškārt, tiesas dokumentu piegādāšanas un izsniegšanas raksturojuma, kas sastāv no piegādāšanas, izsniegšanas procesa, adreses nozīmes un ietekmes tiesas dokumentu piegādāšanā un izsniegšanā, un paziņošanas prezumpcijas analīzes. Master's thesis „Court notifications, summonses and delivery and service of judicial documents” contains research of the problems of court documents, including the form and content, and the problems of delivery and service of documents, taking in consideration the importance of this question in the light of the rights of individuals to have information and the rights to have adequate protection of their interests in court, the court’s process efficiency and speed and the existing problems in practice. The viewed topic indicates the need to estimate the changes and solve still existing and new shortages of this area, which affects such problems of the area, that is related to the electronic, audio and other form, the impact of length of a court judgment on congestion, linking of notification and being informed, more precise adjustment of delivery of summons, and many other important aspects. Master's thesis consists of three sections, first of all, importance of court documents and their service in civil proceedings, secondly, problems of the court documents, namely, analysis of the nature of court documents, analysis of its form and content, and, thirdly, characterization of delivery and service of judicial documents, which consists of delivery and service process, the role and influence of addresses in the delivery and service, and the presumption of notification analysis.
