Eiropas nozīmes dabas teritorijas (Natura 2000) Latvijā: tiesiskā aizsardzības īpatnības

Abstract

Maģistra darbs „Eiropas nozīmes dabas teritorijas (Natura 2000) Latvijā: tiesiskās aizsardzības īpatnības” sniedz ieskatu par Natura 2000 tīklu un tā īstenošanu Latvijā. Darba mērķis ir identificēt Natura 2000 teritoriju tiesiskās aizsardzības īpatnības un ar to saistīto problemātiku, kā arī rast iespējamos risinājumus. Darbā ir pētīti Natura 2000 tīkla institūts un tā nozīme dabas aizsardzībā, Natura 2000 teritoriju izveidošanas process, kas ietver arī šo teritoriju paplašināšanu, kā arī projektu īstenošanas iespējas Natura 2000 teritorijā un tās tuvumā. Noslēgumā darbā tie apskatītas Eiropas Savienības prioritāro sugu un biotopu tiesiskās aizsardzības iespējas ārpus Natura 2000 teritorijas. Minētie jautājumi darbā tiek aplūkoti gan caur teorētisko, gan praktisko prizmu, nacionālā un Eiropas Savienības līmenī. Darba rezultātā autore secina, ka Latvijas regulējumā atsevišķos posmos ir konstatējamas nepilnības gan Natura 2000 teritoriju izveidošanas procesā, gan projektu novērtēšanas procesā, kā arī Eiropas Savienības prioritāro sugu un biotopu aizsardzībā ārpus Natura 2000 teritorijām. Master’s Thesis „Natural areas of European importance (Natura 2000) in Latvia: peculiarities of legal protection”, provides insight into the network of Natura 2000 sites and it’s implementation in Latvia. The aim of the Master’s Thesis is to identify peculiarities of legal protection of Natura 2000 sites and the main issues related to it, as well as to find the possible solutions. For this reason the author has investigated the institute of networks of Natura 2000 and its role in nature conservation, the process of formation of Natura 2000 sites, including site expansion, as well as feasibility of the projects in Natura 2000 site and its proximity. Finally the author discusses the opportunities of legal protection of European Union priority species and habitats which are outside the Natura 2000 sites. These issues are considered from both theoretical and practial point of view, at national and European Union level. The results of the study show that in Latvia there have been some problems with the formation process of Natura 2000 sites and assessment process of projects, as well as consvervation of European Union priority species and habitats outside Natura 2000 sites.
