Zur LanganzeigeZusammenfassung
Tieslietu padome Latvijā pastāv nepilnus piecus gadus, tā ir izveidota ar mērķi stiprināt tiesu varas neatkarību, pārstāvēt tiesu varas viedokli, pilnveidot tiesu sistēmas darba organizāciju. Pastāvošais regulējums Latvijā nav pietiekams, lai Tieslietu padome spētu efektīvi un pilnvērtīgi īstenot tās izveidošanas mērķi. Lai Tieslietu padome spētu stiprināt tiesu varas neatkarību, nepieciešams palielināt Tieslietu padomes kompetences apjomu, jāpilnveido valsts varu atzaru savstarpējo sadarbību, stiprinot pārējo varas atzaru cieņu pret Tieslietu padomes izteikto viedokli. Stiprinot tiesnešu neatkarību, tādējādi stiprinot arī tiesu varas neatkarību, autores ieskatā nepieciešams noteikt regulējumu, kas paredz, ka Tieslietu padomei jāsniedz pamatojums, pieņemot lēmums tiesnešu karjeras jautājumos.
Atslēgvārdi: tiesu varas neatkarība, cieņpilns dialogs, tiesnešu karjera, priekšlikumi. Council for the Judiciary in Latvia exists for less than five years, it has been established with the aim of strengthening the independence of the judiciary, to represent the views of the judiciary, to improve the organization of the judicial system work. The current framework in Latvia is not sufficient for the Council for the Judiciary to be able to implement effectively and efficiently the purpose of its creation. It is necessary to increase the extent of the competence of the Council for the Judiciary, to improve cooperation between executive power, judicial power and legislative power, strengthening respect from the others state authorities to the views expressed by the Council for the Judiciary, so Council for the Judiciary can be able to strengthen the independence of the judiciary. Strengthening the judges independence, thereby strengthening the independence of the judiciary, in the author's view, it is necessary to establish a framework, which provides that the Council for the Judiciary should provide justification for the adoption of the decision of judges career issues.
Keywords: independence of the judiciary, respectful dialogue, judicial careers, proposals.
