Bakalaura darba “Patērētāja prasījuma tiesības pēc apavu iegādes” pētījuma mērķis ir, izvērtējot normatīvo aktu regulējumu un izpētot tiesu praksi, noskaidrot, kādas ir patērētāja tiesības, iegādājoties apavus.
Darba autore pētīja esošo normatīvo regulējumu Latvijā un ārvalstīs, kā arī pastāvošo tiesu praksi, lai pēcāk izdarītu secinājumus, uz kāda veida apaviem attiecas regulējums, kā patērētāja tiesības, iegādājoties apavus, tiek aizsargātas un kādi ir priekšnoteikumi, lai apavus atzītu par līguma noteikumiem neatbilstošiem.
Pētījuma problēmas būtība ir apavu daudzējādais iedalījums, apavu standartu trūkums, pēc kuriem varētu vadīties eksperti, veicot apavu ekspertīzes. Noslēdzot pētījumu, darba autore izdarīs secinājumus pētījuma ietvaros, kā arī piedāvās normatīvo aktu grozījumus un jaunieviesumus. The research aim of the Bachelor Paper “Consumer Claims When Purchasing Footwear” is to determine what kind of rights a consumer is entitled to when purchasing footwear by examining the regulation of regulatory enactments and researching case law.
The author of the paper researched the existing regulatory enactments in Latvia and abroad, as well as the existing case law in order to draw conclusions – what kind of footwear the regulation applies to, how the consumer's rights are protected when purchasing footwear, and what kind of prerequisites must be met to recognize the footwear as nonconforming to the contract terms.
The essence of the research problem is the varied classification of footwear and the lack of a footwear standard, which could be used by experts when carrying out an expert evaluation of footwear. In the final part of the paper, the author will draw research conclusions and make recommendations for amendments to and novelties of the regulatory enactments.
