Maģistra darba tēma ir „Paternitātes noteikšana un apstrīdēšana”. Paternitātes jautājums mūsdienās kļūst aktuāls arvien lielākam personu lokam. Katram bērnam ir tiesības zināt savus vecākus un prasīt tiesisku noteiktību attiecībā uz viņa personas identitāti. Likumdošana paternitātes jomā arvien tiek pilnveidota un meklēti jauni risinājumi. Maģistra darba mērķis ir izpētīt pastāvošo likumdošanu un judikatūru paternitātes noteikšanā un apstrīdēšanā, apzināt pastāvošās problēmas un izvērtēt likumu grozījumu ietekmi uz jomas sakārtošanu. No vienas puses īpaši pēdējos trijos gados šajā jomā ir paveikts daudz, piemēram, paternitātes atzīšana ir kļuvusi iespējama uz trīspusēja iesnieguma pamata; personai, kas sevi uzskata par bērna bioloģisko tēvu, ir tiesības apstrīdēt paternitāti u.c. No otras puses diskutabli ir jautājumi par likumā noteiktajiem termiņiem attiecībā uz paternitātes apstrīdēšanu; par Bāriņtiesu un Dzimtsarakstu nodaļu līdzdalību paternitātes noteikšanā un apstrīdēšanā. Master's thesis title is: „Determination and contestation of Paternity”. The question of paternity is going to be more actual for an increasing number of people nowadays. Every child has the right to know his or her parents and require the legal certainty according to his or her identity. The legislation in the field of paternity continues improving and the new solutions are being searched. The aim of Master thesis is to investigate the existing legislation and case-law in the determination and contestation of paternity, to identify existing problems and to evaluate the effect of amendments to the law. On the one hand, during the last three years a lot of work is done in this area, for example, recognition of paternity has become possible on the basis of a tripartite application; a person who claims to be the child's biological father has the right to contest paternity, etc. On the other hand, discussible are the questions about the statutory time limits for contesting paternity; about the involvement of Orphan's Courts and the Civil Registry Divisions in paternity determination and contestation.
