Kaitējuma atlīdzināšanas problemātika sauszemes transportlīdzekļu īpašnieku civiltiesiskās atbildības obligātajā apdrošināšanā

Abstract

Pētījuma mērķis ir parādīt šī brīža aktuālākās problēmas kaitējumu atlīdzināšanā sauszemes transportlīdzekļu tiesīgo lietotāju obligātajā civiltiesiskajā apdrošināšanā. Darbā tiek konstatētas problēmas spēkā esošo tiesību normu pielietojumā reālās situācijās, konstatējot transportlīdzekļu tiesīgo lietotāju atbildības pakāpi un atlīdzinot radīto kaitējumu trešajām personām. Tāpat tiek analizētas Latvijas tiesību normu savstarpējās pretrunas, kā arī to atbilstība Eiropas Savienības tiesību normām un Eiropas Savienības Tiesu nolēmumiem. Ņemot vērā Eiropas Savienības tiesību avotu ietekmi uz Latvijas tiesību normām, mēģināts sniegt iespējamos risinājumus, kas izpaužas gan interpretācijā, gan izmaiņu ierosināšanā attiecīgajās tiesību normās.

The goal of this study is to show the current problems of damage compensation in motor vehicle third party liability compulsory insurance. In this work there are identified problems of implementing existing legislation in real-life situations in matters of detection of split liability and compensating the loss of third parties. Similarly, there are analyzed mutual contradictions of Latvian laws as well as their compliance with the regulation of European Union laws and the judgments of the Court of Justice of the European Union. Considering the impact of European Union laws to Latvian legislation, the author in this work has been trying to come up with the possible solutions in terms of interpretation as well as proposing the changes to the relevant legislation.
