dc.description.abstract | Latvijas Republikas Civillikuma normas, kas attiecās uz vienpusēju atkāpšanos no līguma ir pārāk kategoriskas vai neefektīvas. Latvija ir viena no Eiropas savienības dalībvalstīm, tādējādi līgumtiesību attīstība nevar notikt nerēķinoties ar kopējiem Eiropas pilnveidošanās aktiem.
Autore darbā ir izpētījusi no juridiskā viedokļa vienpusēju līguma atkāpšanās tiesisko regulējumu, proti, vienpusējas atkāpšanās tiesiskās sekas, Civillikuma 1587. pantā ietvertos atkāpšanās veidus un Eiropas līgumtiesību principu nepieciešamību un izņēmumus no principa pacta sunt servanda, t.i. apstākļu izmaiņu klauzulu, būtisks līguma pārkāpums un līguma ekonomiskā mērķa sabrukumu.
Darba analīzei izmantoti ne tikai Latvijas tiesību akti, tiesu prakse un juridiskā literatūra, gan ārvalstu regulējums, prakse un zinātniskie raksti. Maģistra darba ietvaros autore ir konstatējusi trūkumus normatīvajos tiesību aktos un izdarījusi secinājumu attiecībā uz vienpusēju atkāpšanos Latvijas Civillikuma ietvarā.

dc.description.abstract | The norms of Latvian civil law regarding unilateral withdrawal from a contract are too categorical and ineffective. Latvia is a part of European Union, therefore contract law development cannot happen without considering the common European legislation.
The author looked at the legal framework of an unilateral withdrawal from a contract and the consequences of such act, the types of withdrawal based on the Civil law Act 1587 and the necessity of the European contract law principles and exceptions from the principle pacta sunt servanda (changed circumstances in contracts) as an essential breach of a contract and a discharge of contractual obligations.
The analysis of the thesis include Latvian and foreign legislation, jurisprudence and legal literature. Within the Master’s Thesis the author has recognised disadvantages in laws and regulations and has drawn conclusions regarding unilateral withdrawal from a contract in Latvian Civil Law.
