Šķīrējtiesa ir pasaulē iecienītākais komercstrīdu izšķiršanas veids. Lai šķīrējtiesas institūts atbilstu mūsdienu komercvidei, gan starptautiskie, gan nacionālie šķīrējtiesas procesu regulējošie normatīvie akti tiek mainīti, modernizēti un pielāgoti jaunajiem apstākļiem. Šodien svarīgs šķīrējtiesas procesa elements ir šķīŗējtiesas nolēmuma tiesiskuma un taisnīguma uzraudzība, kuru var īstenot valsts institūcija izskatot pieteikumus par šķīrējtiesas nolēmuma atcelšanu. Latvijā, atšķirībā no citu pasaules valstu tiesību sistēmām, normas, kuras regulē šķīrējtiesas nolēmuma atcelšanu, ilgstoši nav grozītas. Jaunā Šķīrējtiesu likuma normas nesaskan ar starptautisko šķīrējtiesas nolēmumu atcelšanas praksi. Līdz ar to ir nepieciešams analizēt šķīrējtiesas institūtu regulējošas normas Latvijā un jāpilnveido tās saskaņā ar starptautiski atzītajiem principiem. The tribunal is the world's most popular way of resolving commercial disputes. In order to comply with the arbitration institute of modern commercial environment, both, international and national arbitration laws and regulations, are changing, modernized and adapted to new circumstances. Today, an important element in the arbitration process is the arbitration award rule of law and justice supervision, which shall be implemented a public authority by examining applications for annulment of an arbitration award. Despite on other country examples, for a long period of time there has not been any changes in Latvian legal acts governing the setting aside of an arbitration award. The new Arbitration Act is inconsistent with the provisions of ruling international arbitration practise of setting aside the award. Therefore, it is necessary to analyze the rules governing the Latvian arbitration institute and develop itin accordance with internationally accepted principles.
