Pārdzīvojušā laulātā mantas daļas izdalīšanas process teorijā un praksē

Abstract

Maģistra darba tēma ir „Pārdzīvojušā laulātā mantas daļas izdalīšanas process teorijā un praksē”. Pētījuma mērķis ir izpētot pārdzīvojušā laulātā mantas daļas izdalīšanas procesu teorijā un praksē, apzināt problēmas, kas ir saistītas ar šo procesu, un piedāvāt to risinājumu. Pētījuma uzdevumi ir parādīt pārdzīvojušā laulātā mantas daļas izdalīšanas procesa attīstību laika posmā no 19.gs. līdz mūsdienām, apskatīt tiesas prakses tendences šā jautājuma risināšanā, analizēt pārdzīvojušā laulātā mantas daļas izdalīšanas procesa tiesisko regulējumu, izpētīt citu valstu pieredzi šajā procesā. Pārdzīvojušā laulātā mantas daļas izdalīšanas process nav pilnībā noregulēts normatīvajos aktos, līdz ar to šā procesa norise praksē ir pretrunīga. Grūtības pārdzīvojušā laulātā mantas daļas izdalīšanas procesā rodas laulāto likumisko mantisko attiecību sistēmā, kurā pārdzīvojušā laulātā kopmantas daļas izdalīšanas process notiek tāpat kā laulāto kopīgās mantas dalīšana ar tādu atšķirību, ka otrā laulātā vietā nostājas mantinieks.

Theme of the master's thesis is "Distribution process of the surviving spouse’s property part in theory and in practice". The objective of the study is by exploring the distribution process of the surviving spouse’s property part in theory and in practice, to identify problems, which are associated with this process, and offer their solutions. The study objectives are to show the distribution process of the surviving spouse’s property part development within the time period from 19th century up to the present day, review the court practice trends in addressing this issue, analyze the legal framework of the distribution process of the surviving spouse’s property part, and explore the experience of other countries in this process. The distribution process of the surviving spouse’s property part is not fully regulated by normative acts, wherewith the procedure of this process in practice is controversial. The difficulties in the distribution process of the surviving spouse’s property part occur in the statutory matrimonial property relationship system, in which the extraction process of the surviving spouse’s joint property part goes in the same way as distribution of the spouses' joint property, with the difference that the heir takes position of the other spouse.
