Promocijas darbs „Eitanāzijas ētiskie un krimināltiesiskie aspekti” ir starpdisciplinārs pētījums, kas izpaužas jaunas koncepcijas izstrādē, tajā nosakot nedziedināmi slimu cilvēku tiesību apjomu sava mērķa, t.i., priekšlaicīgi pārtraukt organisma dzīvotspēju vai nenovērst slimības izraisītu nāvi, sasniegšanai iesaistīt citus indivīdus, un šo trešo personu darbību vai bezdarbību pieļaujamās robežas, piedaloties nedziedināmi slimu cilvēku slimības izraisīto mokošo sāpju un ciešanu izbeigšanas procesā. Pētījumā centrālā vērība tiek pievērsta eitanāzijas jēdzieniskai izpratnei, izpētes laikā identificējot un definējot patstāvīgas eitanāzijas formas un to veidus, šādi nosakot dzīvības izbeigšanas vai slimības izraisītās nāves nenovēršanas aiz līdzcietības priekšmetisko saturu. Līdz šim precīzas juridiskas klasifikācijas neesamība daudzu zinātņu nozaru ietvaros veicināja „pseidoeitanāzijas” formu izveidi un attīstību, deformējot tradicionālos priekšstatus par to, kas tad patiesībā ir eitanāzija un kādi ir bijuši tās sākotnējie mērķi, un to nepamatotu attiecināšanu uz tādām dzīvības izbeigšanas vai slimības izraisītās nāves nenovēršanas formām, kurām nav nekā kopīga ar tā saucamo „vieglo nāvi”. Līdz ar jaunas klasifikācijas izveidi tiek sekmēta eitanāzijas institūta vienveidīga izpratne, noteikts tā teorētiskais un praktiskais ietvars, kas ļauj eitanāzijas patstāvīgās formas un to veidus, ievērojot katra individuālās pazīmes, nošķirt ne vien sasvstarpēji, bet arī norobežot no medicīniski korektām darbībām, kuras ik dienu tiek praktizētas nedziedināmi slimu cilvēku aprūpes ietvaros, vai arī no nonāvēšanas. Ņemot vērā, ka arī šo nodarījumu apdraudējuma objekts ir cilvēka dzīvība un tie raksturojas ar augstu kaitīguma pakāpi, balstoties uz eitanāzijas institūta attīstības tendencēm pasaulē, promocijas darbā tiek aktualizēts jautājums ar ierosinājumu kriminalizēt patstāvīgu eitanāzijas formu – asistēto pašnāvību un taisnīga krimināltiesiskā regulējuma noteikšanu pārējām eitanāzijas formām un to veidiem, ievērojot vainīgās personas motīvu un mērķi, ar diferencētu atbildības pakāpi pret sekām. Pēc plašu teorētisko nostādņu, ārvalstu normatīvo aktu un tiesu prakses vispusīgas izpētes, izteikti priekšlikumi papildināt Krimināllikumu ar jauniem un līdz šim nepazīstamiem noziedzīgu nodarījumu sastāviem, piedāvājot attiecīgo pantu redakcijas. The doctoral thesis ”Ethical and Criminal Aspects of Euthanasia” is an interdisciplinary research offering the development of a new concept in which the scope of incurably ill persons’ rights is determined to involve other individuals in order to reach the aim, i.e., prematurely discontinue the vital functions of the body or not to prolong the moment when natural death occurs and the act or failure to act within allowable limits, by participating in the process of terminating the excruciating pain and suffering caused by the incurably ill persons’ illness. In the research the main attention is paid to the conceptual understanding of euthanasia, identifying and defining its individual forms and types, thus determining the subject matter of life termination or not preventing the death caused by illness out of compassion. Up to now the absence of accurate legal classification within many fields of science has facilitated the development of ”pseudo euthanasia” forms, thus deforming the traditional concept of what euthanasia is and what its initial aims had been and its unjustified attribution to such life termination or not preventing the death caused by illness forms which have nothing in common with the so called ”easy death”. By developing a new classification, a uniform understanding of euthanasia institution is facilitated, its practical and theoretical framework has been determined, which allows us to distinguish not only between the mutual forms and types of euthanasia taking into account the individual characteristics, but also to draw a boundary from medically correct actions which are practiced on a daily basis when taking care of incurably ill patients or draw a boundary from killing. Taking into consideration the fact that the threatened object of these offences is a person’s life and they are characterized by a high level of harm, basing on the development trends of euthanasia institution in the world, the thesis brings the issue up to date with a proposal to criminalize an independent form of euthanasia – assisted suicide and determination of a fair criminal legal regulation for other forms and types of euthanasia, taking into account the offender’s motive and aim with a differentiated degree of responsibility concerning the consequences. After a wide analysis of theoretical viewpoints and thorough research of foreign regulatory enactments and court practices, proposals have been offered to add new and previously unknown constituent elements of criminal offences to the Criminal Law, offering the wording of the respective articles.
