Hipersaites publicēšana kā iespējams autortiesību pārkāpums

Abstract

Pētījuma mērķis ir noskaidrot, kā mūsdienu autortiesību regulējums definē hipersaites publicēšanu, un identificēt, kādos gadījumos hipersaites publicēšana var radīt autortiesību aizskārumu. Ar hipersaites publicēšanas palīdzību internetā var viegli tikt radīta pieeja dažādiem darbiem, taču autortiesību īpašnieku interesēs nereti ir šāda veida darba izplatības ierobežošana. Autortiesību aizsardzība saduras ar tiesībām uz brīvu informācijas apmaiņu un vārda brīvību, līdz ar to šo tiesību līdzsvarošanai interneta vidē ir būtiska nozīme. Līdz ar to šajā maģistra darbā ir raksturots, kādos gadījumos interneta lietotāji var brīvi publicēt hipersaites uz dažādiem darbiem un kādos gadījumos hipersaites publicēšana bez tiesību īpašnieka piekrišanas būtu uzskatāma par autortiesību pārkāpumu. The aim of this study is to determine how hyperlinking is defined under existing copyright law and to identify in what circumstances hyperlinking may cause copyright infringement. Through hyperlinks different works can be easily accessed through the Internet, but often it is in the interests of copyright holders to limit the dissemination of their works in such manner. Protection of copyrights clashes with freedom of speech and freedom to exchange information, thus balancing those rights is crucial in the Internet environment. Therefore it is described in this master thesis in what circumstances users of the Internet may freely hyperlink to different works, and when the permission of the right holder should be sought prior to posting a hyperlink to a certain work to avoid infringing copyrights.
