Atjaunojot Latvijas Republikas valstisko neatkarību un Latvijas Republikas 1937.gada Civillikuma lietu tiesību daļas darbību, bija nepieciešams veikt zemes reformu, kuras ietvaros agrākiem zemes īpašniekiem vai viņu mantiniekiem bija jāatgriež nelikumīgi atņemtie īpašumi, kā arī bija nepieciešams rast tiesisku risinājumu, lai aizsargātu īpašuma tiesības tiem ēku īpašniekiem, kuri ēkas padomju varas gados bija uzcēluši uz valsts zemes, t.i., uz agrāko īpašnieku zemes. Lai risinātu šīs tiesiskās attiecības, kā izņēmums no Civillikuma 968.pantā noteiktā ēkas un zemes vienotības principa, tika pieņemti speciāli likumi, kuri noteica dalīto īpašumu pastāvēšanu bez laika termiņa ierobežojuma, kur zemes īpašniekiem nepieder ēkas, kuras atrodas uz viņu zemes, bet ēku (dzīvokļu) īpašniekiem nepieder zeme uz kuras atrodas dzīvojamās mājas. Rezultātā izveidojās dalīts īpašums un piespiedu nomas attiecības starp ēkas (dzīvokļu) īpašnieku un zemes īpašnieku, kur daudzās iesaistītās puses apgrūtina lēmuma pieņemšanu par zemes piespiedu nomas līguma noteikumiem. 2015.gadā Latvijā ir 285 849 ēkas un būves, izņemot inženierbūves, kuras atrodas uz citām personām piederošiem 94 254 zemes gabaliem. Piespiedu dalītā īpašuma tiesiskās attiecībās ir 3 677 privatizētās daudzdzīvokļu mājas (kas kopā veido 110 970 dzīvokļus), tās atrodas uz 7 354 citām personām piederošiem zemes gabaliem. Maģistra darba "Dalīta īpašuma problēmas un iespējamie risinājumi Latvijā" mērķis ir izpētīt dalītā īpašuma tiesību institūtu Latvijas tiesību sistēmā, ar to saistītās problēmas, kas deformē Civillikumā ietverto zemes un ēku vienotības principu, apskatīt tiesu praksi, veiktos pētījumus un juristu viedokļus par dalītā īpašuma problēmām Latvijā, kā arī nobeigumā sniegt vērtējumu un priekšlikumus dalītu īpašumu izbeigšanai Latvijas tiesībās. Maģistra darba noslēgumā apkopoti autora secinājumi un priekšlikumi par dalīta īpašuma problēmām un iespējamiem risinājumiem Latvijā. Restoring the independence of the Republic of Latvia and Property Rights of 1937 Civil Code of the Republic of Latvia it was necessary to realize land reform where previous landowners or their heirs must receive back illegally deprived properties, as well as it was necessary to find a legal solution to protect the property rights of those building owners who built their buildings on the state land (on the land of former landowners) during the Soviet time. In order to solve previously mentioned legal relationships there was adopted special laws as an exception to the Article 968 of Civil Code that defines the principle of land and building unity. These laws established existence of divided property without a time limitation where buildings that built on landowner's land do not belongs to the landowner, but owners of the buildings (apartments) do not own the land where the residential buildings are constructed. It led to the divided property and compulsory lease relations between owners of buildings (apartments) and landowners where many involved parties' makes difficult decision-making on regulations of land lease agreement. In 2015 in Latvia are 285 849 buildings, with the exception of engineering structures, which are located on the 94 254 parcels that belongs to the other persons. 3 677 privatized apartment houses (which together account for 110 970 apartments) are at the legal relations of forced divided property. They are located on the 7 354 other persons owned parcels. The aim of Master's Thesis "Divided property problems and possible solutions in Latvia" is to research the law institute of the divided property inside the legal system of Latvia and related problem issues that distort the principle of land and building unity included in Civil Code, to look at the case law, researches and lawyers’ opinions about divided property problems in Latvia, and at the end to provide an assessment and recommendations about the termination of divided properties in Latvian law. The closure of Master thesis contains author's conclusions and proposals for divided property problems and possible solutions in Latvia.
