Abstract

Maģistra darbā ‘‘Uzņēmējdarbības vide un Satversmes tiesa: Satversmes tiesas nolēmumu nozīme izcilas uzņēmējdarbības vides veidošanā Latvijā’’ sniegta uzņēmējdarbības vidi ietekmējošo faktoru analīze, to atspoguļojums politikas plānošanas dokumentos un normatīvajos aktos. Tāpat maģistra darbā analizēta Satversmes tiesas nozīme uzņēmējdarbības vides veidošanā, īpašu uzmanību pievēršot tās kompetencei un sprieduma nozīmei. Sīkāk maģistra darbā analizēti autores ieskatā nozīmīgākie Satversmes tiesas spriedumi lietās, kas ierosinātas pēc uzņēmēju pieteikumiem, un to ietekme uz uzņēmējdarbības vidi. Maģistra darba mērķis ir noskaidrot Satversmes tiesas spriedumu ietekmi uz uzņēmējdarbības vides veidošanu Latvijā, sevišķu uzmanību veltot Satversmes tiesā pēc uzņēmēju pieteikumiem pieņemto tiesas spriedumu izpildei. Maģistra darba rezultātā secināts, ka Satversmes tiesa var palīdzēt uzņēmējdarbības tiesiskās vides pilnveidošanā vairāku iemeslu dēļ. Pirmkārt, ne tikai fiziskā persona, bet arī juridiskā persona Satversmes tiesā var iesniegt pieteikumu savu pamattiesību aizsardzībai, otrkārt, Satversmes tiesas sprieduma juridiskā daba un erga omnes spēks padara Satversmes tiesu par efektīvu tiesību aizsardzības institūciju, un, treškārt, ar to, ka Satversmes tiesas spriedumi tiek respektēti un tajos paustās atziņas tiek ņemtas vērā, ne tikai izskatot lietas vispārējās jurisdikcijas tiesā sakarā ar jaunatklātiem apstākļiem, bet arī likumdevēja darbā. The Masters thesis ‘‘Business environment and Constitutional Court: importance of Constitutional Court rullings to excellent business environment in Latvia’’ provides an analysis of the business environment influencing factors, its reflection in the policy planning documents and laws. As well the author analyzes the role of the Constitutional Court of the business environment, paying particular attention to its competence and importance of its judgements. More detail author analyzes in author's opinion, the most important rulings of the Constitutional Court in cases which arise after business applications and their impact on the business environment. The purpose of the Masters thesis is to clarify the impact of the Constitutional Court judgements on business environment in Latvia, paying special attention to the execution of the Constitutional Court judgements. The results obtained suggest that Constitutional Court can help to develop the legal environment for business development for several reasons. First of all, not only the individual, but also the legal entity, may apply petition for their protection of fundamental rights, on the other, the Constitutional Court judgment and its legal nature and erga omnes force makes the Constitutional Court as an effective law enforcement institution, and thirdly, the fact that the Constitutional Court rulings are respected and their findings are taken into account, not only reviewing cases in court of general jurisdiction, but also they have been taken into account in the work of the legislature.
