Par spīdzināšanas un pazemošanas aizlieguma pārkāpumiem joprojām tiek iesniegtas daudzas sūdzības Eiropas Cilvēktiesību tiesā, kas norāda uz šo aizliegto paņēmienu plašu pielietošanu joprojām. Bakalaura darba mērķis ir analizēt spīdzināšanas un pazemošanas, kā arī citu aizliegto paņēmienu jēdzienus un nošķiršanas pazīmes, kuras nereti praksē ir samērā grūti nošķirt, noskaidrot kā šie aizliegtie paņēmieni praktiski izpaužas, veicot dažādas procesuālās darbības, kā arī noteikt kādu ietekmi un sekas šo paņēmienu pielietošana atstāj uz šo pārkāpumu izdarītājiem, iegūtajiem pierādījumiem un procesu kopumā. Lai sasniegtu darbā noteikto mērķi, autors veica nacionālo un starptautisko tiesību aktu salīdzināšanu un izpēti. Tāpat tika pētīta gan Latvijas, gan ārvalstu tiesību literatūra, kā arī analizēta Latvijas un Eiropas Cilvēktiesību tiesas prakse. Numerous complaints about infringements of torture and humiliating treatment are still being submitted in European Court of Human Rights, which indicates that these prohibited methods are still widely used nowadays. The goal of this bachelor thesis is to analyze concepts and features of torture, humiliating treatment and other illegal methods, which are often quite difficult to distinguish in practice, determine how these illegal methods are implemented through the various steps in the proceedings, as well as to find out what kind of impact and effects the usage of these methods leave on offenders, obtained evidence and the process as a whole. In order to achieve the stated objective, the author compared national and international law, explored Latvian and foreign legal literature, as well as analyzed Latvian and European Court of Human Rights judicial practice.
