Parādu ārpustiesas atgūšanas īpatnības

Abstract

Bakalaura darba mērķis ir konstatēt, kādas īpatnības ir parādu ārpustiesas atgūšanā praktiskajās darbībās un tiesiskajā regulējumā, kā arī efektivitātes noskaidrošana parāda atgūšanā; ar kādām problēmām var saskarties ārpustiesas parādu atgūšanas procesā, kādi tam ir negatīvie un pozitīvie aspekti. Kādā veidā šīs ārpustiesas parāda atgūšanas procesa problēmas labāk atrisinātu. Bakalaura darbs sastāv no ievada, trim nodaļām un secinājumiem. Lai sasniegtu bakalaura darba mērķi, tiks pētīti spēkā esošie normatīvie akti, Latvijas Vēstneša portāls - Likums un Valsti, kā arī publikācijas žurnālā „Jurista Vārds” un juridiskā literatūra. Bakalaura darba rezultātā tiks secināts, kādas ir ārpustiesas parāda atgūšanas īpatnības un kāda ir šī procesa efektivitāte. Atslēgas vārdi: kreditors, parādnieks, parādu atgūšana, parādu piedziņa, parādu atgūšanas veidi, galvotājs, juridiska persona.

The aim of the Bachelor is to establish what specificities are extrajudicial debt recovery activities in practical and legal framework, as well as the effectiveness clarification of debt recovery, identifies problems might encounter in extrajudicial debt recovery process, what are the negative and positive aspects. And how those problems of extrajudicial debt recovery process better solve. The Bachelor consists of Introduction, three chapters and Conclusions. In order to achieve the aim of bachelor, will be explored in force existing laws and regulations, Latvian Journal Portal - Law and State, as well as publications in the journal „Lawyer's Name” and legal literature. Bachelor work as a result will be concluded what it is the extrajudicial debt recovery peculiarities and what is the effectiveness of the process.
