Tiesu komunikācija ar sabiedrību tiesas nolēmumu likumības kontekstā

Abstract

Demokrātiskā tiesiskā valstī primārais varas avots ir tauta. Līdz ar to sabiedrības viedoklim par tiesu varu un tiesas nolēmumu likumību ir ļoti svarīga. Sabiedrībā ir jāvalda pārliecībai par to, ka tiesu darbs norisinās taisnīgi un likumīgi. Diemžēl medijos parādās aizvien vairāk kļūdainas informācijas par tiesu darbu, kā arī tiesu nolēmumi tiek nekorekti interpretēti, līdz ar to būtu jāpievērš pastiprināta uzmanība veidam, kādā tiesa komunicē ar sabiedrību un sniedz informāciju, komentārus par tiesu nolēmumiem. Darbā analizēts tiesiskas un demokrātiskas valsts jēdziens, tiesas nolēmumu likumības kritēriji un tiesu neatkarības jēdziens, analizēti veidi, kādos tiesa komunicē ar sabiedrību, kā arī sniegti ieteikumi tiesu komunikācijas uzlabošanai, sniegts priekšlikums tiesas profila izveidošanai sociālajos mēdijos, kas, iespējams, varētu izraisīt sabiedrības plašāku interesi par tiesu varu. Līdz ar to lielāka sabiedrības daļa, jo īpaši jaunākā paaudze, būtu labāk informēta par tiesu darbu, kas varētu veicināt sabiedrības uzticību tiesu varai.

In a democratic state that is guided by the rule of law, the main source of power is the nation. Therefore the opinion of the nation about the judiciary and the lawfulness of the rulings of courts are of a vital importance. The society must be ensured that the job in courts is fair and lawful. Unfortunately the information in the media about the work of the court is even more and more misleading. The rulings of the court are interpreted incorrectly, therefore the courts should pay more attention on the way how they are communicating with the society or giving commentaries about the rulings. The Author analyzes the concepts of democracy and the rule of law, the criteria of a lawful judgment and the independence of judiciary. Author also analyzes the ways in which courts are communicating with the society and is giving proposals for improving this communication. The Author also proposes to create a courts profile in social media which could possibly lead to more increased interest in the judiciary that could increase public confidence in the judiciary.
