Motīvs un mērķis kā noziedzīga nodarījuma subjektīvās puses elements

Abstract

Bakalaura darba temats ir “Motīvs un mērķis kā noziedzīga nodarījuma subjektīvās puses elements.” Ņemot vērā, ka subjektīvā puse vienmēr ir izraisījusi plašas diskusijas krimināltiesību kontekstā, tad šis temats ir aktuāls arī šobrīd. Būtībā problēmas sagādā vainas formas un to pareiza noteikšana, lai varētu precīzi kvalificēt noziedzīgu nodarījumu. Autore uzskata, ka arī motīvs un mērķis mēdz novest strupceļā, jo, ja tas netiks atklāts, kur to prasa obligāti, tad noziegumu kvalificēt nav iespējams. Darba mērķis ir noskaidrot un izprast motīva un mērķa būtību, šo elementu lomu noziedzīga nodarījuma subjektīvajā pusē, kā arī izzināt problēmas, kas rodas to kvalificēšanā. Darba uzdevumi ir izprast subjektīvo pusi un tās elementu jēdzienus, izpētīt Latvijas Krimināllikumā ietvertos motīvus un mērķus, raksturot visizplatītāko nolūku – mantkārību un izpētīt ārvalstu normatīvo regulējumu attiecībā uz motīvu un mērķi. Bakalaura darbs izstrādāts balstoties uz Latvijas Krimināllikumu, ārvalstu krimināllikumiem un latviešu, ārzemju krimināltiesību autoru viedokļiem, atzinumiem, kā arī Latvijas tiesu praksi.

The theme of the Bachelor’s is ,,Motive and purpose as a subjective element of a criminal offence”. Given that the subjective side always has provoked a broad debate in the context of criminal law, the subject is topical . Essentially, the fault forms and correct determination of them causes problems to accurately classify an offense. The author believes that the motive and intention tend to lead to a dead end, because if it will not be found where it is mandatory, then the crime can not be categorized. The aim of the paper is to identify and understand the nature of motive and intention, their role in a criminal offense’s subjective side as well as to explore issues in their characterization. Tasks for the paper is to understand the subjective side and it’s elements definitions, explore the Latvian Criminal Law containing motives and intentions, describe the most common intention - greed and explore foreign criminal Law regarding motive and intention. Bachelor's work has been based on the Latvian criminal Law, foreign criminal law, Latvian and foreign criminal law authors' views and opinions as well as the Latvian case practice.
