Dzīvokļu īpašnieku biedrības darbības tiesiskā regulējuma pilnveidošanas iespējas Latvijas Republikā.

Abstract

Maģistra darba autors ir Latvijas Universitātes Juridiskās fakultātes maģistra studiju programmas ceturtā semestra students Antons Zagdajs. Maģistra darba zinātniskais vadītājs Dr.iur. Erlens Kalniņš. Maģistra darbs ir veltīts dzīvokļu īpašnieku biedrību darbības pilnveidošanas iespējām Latvijas Republikas dzīvojamo māju pārvaldīšanas nozarē. Autora mērķis ir veikt dzīvokļu īpašnieku biedrību darbības tiesisko un praktisko aspektu izvērtēšanu dzīvokļu īpašumu pārvaldīšanas nozarē Latvijas Republikā, salīdzināt to ar Vācijas Federatīvās Republikas un Igaunijas Republikas normatīviem regulējumiem un izvērtēt atsevišķu vadlīniju piemērošanas iespējas nacionālajā regulējumā. Maģistra darba pirmajā nodaļā autors izskaidro maģistra darbā lietoto terminu daudzīvokļu dzīvojamā māja, biedrība un pārvaldīšana nozīmi un izmantošanas tvērumu. Maģistra darba otrajā nodaļā autors veica Latvijas Republikas dzīvokļu tiesību normatīvoaktu un atsevišķu dzīvokļu īpašnieku biedrību statūtu analīzi, nolūkā konstatēt trūkumus dzīvokļu īpašnieku biedrību regulējumā. Maģistra darba trešās nodaļas ietvaros autors veica Vācijas Federatīvās Republikas un Igaunijas Republikas dzīvokļu īpašnieku kopības un dzīvokļu biedrību normatīvā regulējuma analīzi. Maģistra darba ceturtajā nodaļā autors piedāvā dzīvokļu īpašnieku biedrību tiesiskā regulējuma pilnveidošanas iespējas. Maģistra darbs sastāv no 76 lapas pusēm un 5 priekšlikumiem. Maģistra darbu veido anotācijas latviešu un angļu valodās, satura rādītājs, ievads, četras nodaļas, secinājumu un priekšlikumu daļa, izmantoto avotu saraksts un dokumentārā lapa.

The author of this Master’s thesis is Antons Zagdajs, the fourth semester student of Master of Law study program at the University of Latvia. Scientific supervisor of the thesis is Dr.iur. Erlens Kalniņš. This Master's thesis addresses the question of improvement of apartment owners associations in residential housing management sector. It aims to undertake a legal analysis of both legal and practical aspects of apartment owners associations in property management industry in the Republic of Latvia; as well as to compare it with regulatory frameworks endorsed in the Federal Republic of Germany and the Republic of Estonia. Hereby, author evaluates a possibility of individual guideline application to the national regulation. In the first chapter, author explains concepts of a residential house, apartment owners association and management as well as scope of its usage in this Master’s thesis. In the second chapter, author implements a normative legal acts analysis, which regulates apartment owners’ association operation in the Republic of Latvia; then, conducts apartments and individual apartment owners’ association statutes analysis, aiming to identify downsides of apartment owners’ association regulation. In third chapter of the Master's thesis, apartment owners’ association and apartment owners’ communion regulatory in the German Federal Republic and the Republic of Estonia are analyzed. Finally, in fourth chapter of this thesis author offers a possibility for apartment owners’ association regulation improvement by possible adaptation of a separate law of apartment owners associations. This Master's thesis consists of 76 pages and 5 proposals, abstracts in both Latvian and English, table of contents, introduction, four chapters, conclusion, proposal part, list of used sources and documentary page.
