Abstract
Izvēlētais maģistra darba temats ir „Vienkāršotie kriminālprocesi, kas saistīti ar personas sodīšanu. Teorētiskie aspekti un piemērošanas problemātika”. Darba autora temata izvēle nav nejauša, jo gan pirms, gan arī pēc Kriminālprocesa likuma spēkā stāšanās joprojām aktualitāti nav zaudējušas diskusijas par ātrāku, efektīvāku, lētāku un vienkāršāku kriminālprocesu, neskatoties uz to, ka Kriminālprocesa likums saturiski pietiekami skaidri definē un regulē kriminālprocesa, tā piemērošanas veidu un norises kārtību. Darba autora mērķis un uzdevums ir maģistra darba robežās padziļināti aplūkot vienkāršoto kriminālprocesa veidus, kas saistīti ar personu sodīšanu, to mērķi, piemērošanas tiesisko pamatu, izsecināt piemērošanas problēmas un izvirzīt secinājumus ar ieteikumiem problēmjautājumu risināšanai. Maģistra darba izstrādes procesā aplūkotas Igaunijas un Krievijas kriminālprocesuālās procedūras un tur, kur tas ir iespējams, dots salīdzinājums ar Kriminālprocesa likumā ietvertajiem vienkāršoto procesu veidiem. Izstrādājot maģistra darbu un izejot pirmskvalifikācijas praksi Jūrmalas pilsētas prokuratūrā, darba autors padziļināti ir ieguvis un nostiprinājis zināšanas kriminālprocesuālajās tiesībās.
The chosen theme of the master’s thesis is “Simplified Criminal Procedures that are connected with person’s punishment. Theoretical aspects and application problems.” The author’s selection of the mentioned theme is not accidental because both before and after the criminal law came into force there are still current discussions regarding faster, more efficient, less expensive and simplified criminal procedure, despite the fact that the Criminal Law substantively clearly defines and regulates criminal proceedings, way of its application and procedure. The author’s objective and the task of the diploma work are to thoroughlylook at the forms of Simplified Criminal Proceduresthat are connected with person’s punishment, its purpose, legal basis of its application, to identify application problems and to bring forward concrete conclusions with recommendations to solve the issues. While elaborating the master’s thesis the criminal proceedings of Estonia and Russiawere looked at and as far as possible, the comparison of forms of simplified criminal procedures contained in the Criminal Law will be given. During the diploma work’s development and while attending prequalification internship at Jurmala City Prosecution Office, the author has obtained and strengthened in-depth knowledge of criminal proceedings.
