Cietsirdība un vardarbība pret nepilngadīgo

Abstract

Cietsirdība un vardarbība ir nopietna un bieži vien slēpta sociāla problēma, kas var izraisīt fizisku un emocionālu kaitējumu ar nopietnām sekām. Īpaši bērnam, viņa fiziskā un garīgā brieduma trūkuma dēļ, ir nepieciešama īpaša aizsardzība un atbalsts, lai to pasargāto no visa veida vardarbības. Ņemot vērā temata aktualitāti, autores mērķis ir noskaidrot cietsirdīgas un vardarbīgas izturēšanās pret bērniem saturu, aplūkojot teoriju un praksi. Izvirzītā mērķa sasniegšanai autore veica jēdzienu „cietsirdība” un „vardarbība” izpratni literatūrā un tiesībās, analizēja bērnu tiesību un interešu aizsardzību vēsturiskā, nacionālā un starptautiskā aspektā, veica Krimināllikuma 174. panta juridisko analīzi un tiesu prakses analīzi, kā arī izteica priekšlikumus apzināto problēmu risināšanai. Maģistra darba izstrādes rezultātā autore secina, ka cietsirdība un vardarbība pret bērniem ir aktuāla un nopietna problēma, kuras risināšanā jāturpina normatīvā regulējuma pilnveide un sabiedrības izpratnes maiņa. Darba rezultātā ir izteikti priekšlikumi un atbalstīti gaidāmie grozījumi likuma „Par Krimināllikuma spēkā stāšanās un piemērošanas kārtību” 3. pielikumā attiecībā uz psihisko traucējumu gradāciju.

Cruelty and violence is serious and often hidden social problem that can cause physical and emotional harm with serious consequences. Especially children, because of their physical and mental immaturity, need a special protection and support from all forms of violence. Considering the actuality of the topic, the objective of master's thesis is to find out the content of cruel and violent treatment of children by looking at legal literature sources and court practice. In order to reach the objective of master's thesis, the author analyzed cruelty and violence by researching legal literature and law, analyzed children's rights and protection on their interests in historical, national and international perspective, analyzed Article 174 of Criminal Code of the Republic of Latvia and case law, and also made proposals to the identified problems. The author concludes that children protection against cruelty and violence is an urgent and serious problem which must be solved by improving current regulation and by changing public point of view. As the result of study, author made proposals and also supported the forthcoming amendments to the Annex 3 of the Law on the Procedures for the Coming into Force and Application of the Criminal Law which relates to graduation of mental disorders.
