Nelikumīgas būvniecības seku novēršana

Abstract

Maģistra darbs „Nelikumīgās būvniecības seku novēršana” ir veltīts Latvijā aktuālajai nelikumīgās būvniecības tiesisko aspektu problemātikai. Darba mērķis ir, izpētot nelikumīgas būvniecības tiesiskā regulējuma vēsturisko attīstību Latvijā, identificēt un rast risinājumus problēmām, kas saistās ar patvaļīgu un nelikumīgu būvniecību, tostarp tās ietekmējošiem cēloņiem, kas izriet no Būvniecības likuma un citiem saistītiem normatīvajiem aktiem. Darbā analizēta būvniecības procesa tiesiskā regulējuma piemērošana nelikumīgas būvniecības novēršanā, samērīguma izvērtēšanas nozīme, kā arī identificētas problēmas, saistībā ar būvatļaujas izdošanu. Darbā autors ir nonācis pie secinājumiem un priekšlikumiem, tostarp pie novatoriskas atziņas, par būvniecības legalizēšanas procesu atvieglošanu personām ar invaliditāti.

Master Thesis "Elimination of the Consequences in Illegal Construction" is dedicated to the urgent issues with regard to the illegal construction problem in Lat-via. The aim of the Thesis is to investigate illegal construction legislation historical de-velopment of Latvia, to identify and find solutions to problems related to the arbitrary and illegal construction, including those affecting the causes arising from the Con-struction Law and other related laws and regulations. Thesis analyzes the construction process of the legal regulation on the prevention of illegal construction, the propor-tionality evaluation role, as well as the how these problems have been identified in connection with the issuance of a building permit. The author has come to the conclusions and proposals, including the innova-tive ideas for the construction of legalization process with regard to the issuance of building permit.
