Prejudiciālā nolēmuma nozīme konstitucionālās tiesas procesā

Līguma par Eiropas Savienības darbību 267. panta regulējums ievieš prejudiciālo nolēmumu procedūru, tomēr ne panta formulējums, ne citi to regulējošie tiesību akti nenosaka pantā ietvertā jēdziena “tiesa” saturu, kā arī to, vai konstitucionālās tiesas ietilpst šī panta subjektu lokā. Tā rezultātā tiesību zinātnieku vidū ir radušās neskaidrības, vai saskaņā ar panta trešo daļu, konstitucionālās tiesas būtu jāuzskata par “tiesu, kuras nolēmumus nevar pārsūdzēt”. Darba mērķis ir analizēt konstitucionālo tiesu atbilstību LESD 267. pantā ietvertajam jēdzienam “tiesa”, padziļināti izpētot Eiropas Savienības dalībvalstu konstitucionālo tiesu praksi. Darba ietvaros autore analizē prejudiciālā nolēmuma būtību, Eiropas Savienības Tiesas spriedumus un ģenerāladvokātu secinājumus, kā arī pēta dalībvalstu konstitucionālo tiesu lēmumus. Autore, pētot Eiropas Savienības Tiesas un konstitucionālo tiesu judikatūru, kā arī tiesību zinātnieku doktrīnu, izanalizē aktuālos problēmjautājumus, kas saistīti ar konstitucionālo tiesu kā LESD 267. panta subjektu. Article 267 of the Treaty on the Functioning of the European Union introduces the procedure of the preliminary ruling; however neither formulation of the Article, nor the other EU law applicable in this area does not provide the definition of notion of “court” as well as whether constitutional courts fall within the scope of Article 267. Thus, disagreement among legal experts has emerged on topic whether, in accordance to third paragraph, constitutional courts are considered as courts against whose decisions there is no judicial remedy. The aim of this study is to analyse the compliance of the constitutional court to the notion of “court” stated in Article 267 of TFEU by conducting an in-depth research on the legal practise of constitutional courts among European Union member states. In this paper the author examines the substance of the preliminary ruling, the judgements of the Court of Justice of the European Union, Opinions of the Advocate Generals, as well as decisions of Constitutional Courts. The author tackles the challenging questions regarding the constitutional court as the subject of the Article 267 by analysing the case-law of the Court of Justice of the European Union and case-law of Constitutional Court as well as legal doctrine.
