Darba ietvaros tiek veikta Latvijas Republikas un Eiropas Savienības Tiesas prakses un doktrīnas izpēte par Eiropas Parlamenta un Padomes Direktīvas Nr. 2004/48/EK par intelektuālā īpašuma tiesību piemērošanu jeb Piemērošanas direktīvas interpretāciju un ieviešanu Latvijas Republikas tiesību sistēmā attiecībā uz kaitējuma atlīdzības piedziņas kārtību strīdos par tiesībām uz preču zīmi izpēte. Darba mērķis ir izprast iepriekš minētajā direktīvā noteikto kaitējuma atlīdzības piedziņas kārtību un sniegt priekšlikumus nepieciešamo izmaiņu īstenošanai Latvijas tiesību sistēmā atbilstoši Piemērošanas direktīvas prasībām. Darba rezultāts ir pētījums par Latvijas Republikā piemēroto zaudējumu atlīdzības piedziņas kārtību strīdos par tiesībām uz preču zīmēm, kura ietvaros tiek sniegti vairāki priekšlikumi par nepieciešamajām izmaiņām normatīvajos aktos, tiesu prakses apkopojumā un tiesību normu interpretācijas procesā, lai īstenotu efektīvu kaitējuma atlīdzības piedziņu strīdos par tiesībām uz preču zīmēm. The bachelor’s thesis is devoted to the research of case law of the Republic of Latvia and European Union, particularly focusing on the study of doctrine concerning European Parliament and Council’s Directive No. 2004/48/EK on the enforcement of intellectual property rights or the Enforcement directive, the interpretation and implementation of it within the legal system of the Republic of Latvia in relation to the regulation of reimbursement of damages in disputes of rights for trademark. The aim of the thesis is to understand the institute of the recovery of the reimbursement of damages in disputes on the rights for the trademark, established in the directive mentioned before, and to make proposals on the implementation of necessary amendments in the legal framework of the Republic of Latvia in accordance with the requirements of the Enforcement directive. The result of the bachelor’s thesis is a research of the recovery procedure applicable in the Republic of Latvia for the reimbursement of damages in disputes on the rights for trademarks, within this thesis the author has presented numerous proposals on necessary amendments in regulatory enactments, compilations of court decisions and in the process of the interpretation of legal norms to carry out an effective reimbursement of damages in disputes on the rights for the trademarks.
