Drošības dienestu disciplināratbildības piemērošanas problemātika

Abstract

Bakalaura darbā „Drošības dienestu disciplināratbildības piemērošanas problemātika”, ir apskatīts drošības dienestu - Valsts policijas, Valsts ugunsdzēsības un glābšanas dienesta un Valsts robežsardzes disciplināratbildības institūts, disciplinārpārkāpumu tiesu prakse, Iekšlietu ministrijas sistēmas iestāžu un Ieslodzījuma vietu pārvaldes amatpersonu ar speciālajām dienesta pakāpēm disciplināratbildības likuma regulējums par vainas formām, salīdzinājumā ar Krimināllikumā minēto vainas formu regulējumu, disciplinārpārkāpuma seku nozīme, pieteikuma priekšmetu kļūdas pārsūdzot disciplinārsodu un iestādes pieļautās kļūdas piemērojot disciplinārsodu, kā arī šo kļūdu nozīme tiesvedībā. Darbs saistīts ar tiesu spriedumu izpēti un problēmu konstatēšanu, kā arī priekšlikumu piedāvāšanu, normatīvo aktu uzlabošanai. Darba autors konstatē, ka Iekšlietu ministrijas sistēmas iestāžu un Ieslodzījuma vietu pārvaldes amatpersonu ar speciālajām dienesta pakāpēm disciplināratbildības likumā ir nepieciešams pilnveidot regulējumu par vainas formām, kā arī konstatē nepilnības disciplinārsoda piemērošanas jautājumos.

The author of the bachelor thesis „Issues of disciplinary responsibility of the security services” examines performance of the State Police, State Fire and Rescue Service and the State Border Guard disciplinary institute, disciplinary offense in court judgments, the Ministry of Interior system institutions. Also thesis includes a research on such topics as the disciplinary regulation of guilt forms in Ministry of Interior System Institutions Prison and Administration officials with special service ranks law compared to the Criminal Law of guilt form regulation, examines the role of disciplinary consequences in the disciplinary cases and application object mistakes made in court judgments in disciplinary cases, and institution errors issuing mandatory administrative act, as well as the significance of these mistakes in the proceedings. Work involves the research of the court judgments and identifying of the problems. Also author of the thesis gives advice on improving the law regulations. The author recognizes that the disciplinary law of Ministry of the Interior and the institutions of the Prison Administration officials with specials service ranks needs to be improved and finds certain flaws in issues when the disciplinary judgment is applied.
