Maģistra darbā analizēta nāvessoda piemērošanas problemātika un tā pretruna tiesībām uz dzīvību. Izpētes rezultātā secināts, ka nāvessods nevar tikt uzskatīts par soda veidu, bet gan valstiski izdarītu slepkavību. Ar nāvessoda palīdzību nav iespējams sasniegt soda mērķus, bet gan iebaidīt. Izņēmums, kad pieļaujama valstiski izdarīta slepkavība ir citādi nenovēršamu, cilvēku dzīvībai pastāvošu briesmu gadījumā, kad neeksistē citi, tiesību mazāk ierobežojoši līdzekļi. Nepieciešams starptautiski noteikt un darīt saistošu tiesību uz dzīvību sākuma brīdi un piemērot atbilstošus augļa aizsardzības pasākumus. There is analyzed the problematics of application of death penalty contrary to rights to life in this Master's thesis. Is is discovered that death penalty can not be seen as a punishment, but state executed murder. The death penalty can not reach the goals of punishment, instead of intimidate. The only exception when state executed murder can be applied is otherwise unavoidable danger to human life when there are no other rights less limiting options. It is necessary to define and make mandatory the understanding of starting point of rights to life in an international level and apply adequate actions of fetus protection.
