Direktīvu horizontālās tiešās iedarbības problemātika Eiropas Savienībā

Abstract

Bakalaura darba mērķis ir analizēt ES Tiesas spriedumus par direktīvu tiešo iedarbību, īpašu uzmanību pievēršot ES Tiesas sniegtajai interpretācijai par valsts institūcijas jēdzienu un kritērijiem, kurai tai ir jāatbilst, lai to varētu uzskatīt par valsts institūciju. Darbā tiek skaidroti tiešās piemērojamības un tiešās iedarbības jēdzieni un kā tiešā piemērojamība un tiešā iedarbība izspaužas ES tiesību aktos. Tiek analizēta arī direktīvu tiešā iedarbība. Darbā tiek analizēti arī ES Tiesas spriedumi par direktīvu tiešo iedarbību. Bakalaura darbā tiek pētīts, kādu valsts institūcijas jēdzienu ES Tiesa ir noteikusi savos spriedumos par direktīvu tiešo iedarbību. Tiek noskaidrots arī pret kādiem privāto tiesību subjektiem persona var vērsties, atsaucoties uz direktīvas noteikumiem. Aim of the thesis is to analyze judgments of the Court of Justice of the European Union on the direct effect of directives, paying particular attention to the interpretation given by the Court of Justice of the European Union on the concept and criteria of public body , which it must meet in order to be considered a public body. Thesis explains the concepts of direct applicability and direct effect, and explains the direct applicability and direct effect of EU law. Also are analyzed the direct effect of directives. Thesis also analyzes judgments of the Court of Justice of the European Union on the direct effect of directives. Thesis examines the concept of public body as defined by the Court of Justice of the European Union in its judgments on the direct effect of directives. It’s also clarified which private law subjects ( body ) person is able to rely on provisions of a directive.
