Parādnieka pienākumi fiziskās personas maksātnespējas procesā

Abstract

Autore bakalaura darbā “Parādnieka pienākumi fiziskās personas maksātnespējas procesā” analizē Maksātnespējas un Civilprocesa likumā noteiktos pienākumus, kas parādniekam jāievēro uzsākot maksātnespējas procesu kā arī bankrota procedūras un saistību dzēšanas procedūras ietvaros. Mērķis ir izprast parādnieka pienākumu klāstu, to atspoguļojumu praksē un meklēt problēmjautājumus un to risinājumus. Lai sasniegtu mērķi darba autore analizē Maksātnespējas likumā noteiktos principus un to ietekmi uz parādnieka pienākumiem, normatīvos aktus, tiesas spriedumus un juridisko literatūru. Secinājumos autore norāda darba gaitā gūtās atziņas.

The author of the bachelor's paper "The duties of a debtor in the process of insolvency of a natural person" analyzes the obligations specified by the Insolvency and Civil Procedure Law which must be followed by the debtor when starting insolvency proceeding, as well as in the context of bankruptcy and redemption procedures. The work’s aim is to understand the range of obligations of the debtor and their reflection in practice, to look for the issues and their solutions. In order to achieve the goal, the author of the paper analyzes the principles set out in the Insolvency Law and their impact on the debtor's duties, normative acts, court verdicts and legal literature. In the conclusion the author indicates the lessons learned throughout the work.
