Abstract

Bakalaura darba temats ir “Atbildību mīkstinošie apstākļi” Pētījuma aktualitāti nosaka, tas, ka lai arī kopš 20. gadsimta sākuma normatīvajos aktos ir pastāvējusi iespēja samazināt sodu, ja ir konstatēti atbildību mīkstinoši apstākļi, tomēr pētot tiesu praksi joprojām tiek konstatētas problēmas ar atbildību mīkstinošo apstākļu konstatēšanu un piemērošanu, kas var būt par pamatu nesamērīga un līdz ar to netaisnīga soda noteikšanai. Bakalaura darbā pētīta atbildību mīkstinošo apstākļu vēsturiskā attīstība, būtība, nozīme un veidi, kā arī piemērošana praksē. The title of the research is “Mitigating circumstances”. The topicality of the research is determined by the fact that, although it has been possible to reduce the sentence from the beginning of the 20th century, if mitigating circumstances have been established, however, the study of court practice still reveals problems with identifying and applying mitigating circumstances that may be the basis of disproportionate and thereby unfair punishment. The research studies the historical development of mitigating circumstances, the essence of such circumstances, meaning and types of mitigating circumstances, as well as application in practice. Research includes comparison of the mitigating circumstances of Latvia and foreign countries. Keywords – punishment, determination of sentence, penalty measure, lighter punishment.
