Maģistra darbā aplūkota Satversmes tiesas spriedumu nolēmumu daļas piemērošanas problemātika, kas nav plaši pētīta, bet ir nozīmīga Satversmes tiesas sprieduma sastāvdaļa, skatot augstāka juridiskā spēka tiesību aktam neatbilstošas tiesību normas spēka zaudēšanu. Darba mērķis ir apzināt Satversmes tiesas spriedumu nolēmumu daļas piemērošanas nosacījumus un veidus konstitucionālajā tiesvedībā. Lai to sasniegtu, autore pētīs Satversmes tiesas sprieduma nolēmuma daļas saturu un dažādību, kā arī analizēs nolēmuma daļas piemērošanas veidus un izpildes procesu. Darbā iegūtie rezultāti: autore piedāvā Satversmes tiesas spriedumu nolēmumu daļas iedalījumu pēc tā stāšanās spēkā veida, kā arī izvirza priekšlikumus Satversmes tiesas sprieduma nolēmumu daļas piemērošanas procesa noteikšanai, atvieglojot tā izpildi. The Master’s thesis discusses issues in adjustment process of the Constitutional Court’s decisions. The ruling part of the Constitutional Court’s decision has not been extensively studied in the Latvian constitutional system, but it is an essential part of the Constitutional Court’s decision when unconstitutional norm has to be applied. The objective of this thesis is to identify adjustment process of the ruling part and criteria for implementation in the constitutional proceedings. To reach the aim author will research the concept and status of the Constitutional Court’s decision and analyze Constitutional Court’s decision entry into the force. The results of the thesis: the author presents types of the ruling part of the Constitutional Court’s decisions as well as makes proposals for determining the application process of the ruling part of the Constitutional Court decision, facilitating its execution.
