Iepirkumiem valsts aizsardzības un drošības jomā ir atvēlēti ievērojami līdzekļi. Ne vienmēr aizsardzības un drošības jomas iepirkums tiek veikts likumīgi vai nepamatoti neveikts vispār, pamatojoties uz īpašiem jomu raksturojošiem izņēmumiem. Tādējādi tiek prettiesiski ierobežota konkurence piegādātāju starpā, atkāpjoties no ES noteiktajām pamatbrīvībām. Valsts aizsardzības un drošības jomas iepirkumus regulē atšķirīgi noteikumi no iepirkumiem citās jomās. Ņemot vērā aizsardzības un drošības jomas specifiku, risks šīs jomas iepirkumu piemērot nepamatoti ir lielāks. Attiecīgi autors darbā, jo īpaši pamatojoties uz tiesu praksi un teorijas atziņām, raksturo, kā izprotami aizsardzības un drošības jomas iepirkumi un kādos gadījumos tie ir jāveic, kā arī kādos gadījumos dalībvalsts pasūtītājs ir tiesīgs nepiemērot iepirkumu procedūru. Procurement in the field of defence and security is not always legally carried out or unjustifiably is not carried out at all, on the basis of specific exemptions. Thus, competition between suppliers is illegally restricted, derogating from the fundamental freedoms established by the EU law. Procurement in the field of national defence and security is governed by different rules from procurement in other areas. Given the characteristics of the field, the risk of applying defence and security procurement unduly is higher. Accordingly, the author of the paper, in particular on the basis of case-law and theory, describes how procurement in the field of defence and security is understood and in which cases it must be carried out, as well as in which cases the contracting authority of the Member State is entitled not to apply the procurement procedure.
