Bakalaura darba tēma ir “Piedziņas vēršana uz bezķermeniskām lietām”, kas kā viens no piespiedu izpildes līdzekļiem ietverts Civilprocesa likuma 557. pantā. Bakalaura darbā tiks aplūkoti jēdziena “bezķermeniska lieta” saturs un tvērums, nosakot bezķermenisku lietu pazīmes un raksturojumu. Kā arī tiks aplūkota piedziņas vēršana uz bezķermeniskām lietām kā piespiedu izpildes līdzeklis, tā procesuāla puse – apķīlāšana, novērtēšana, pārdošana. Lai gan Civilprocesa likumā piedziņas vēršana uz bezķermeniskām lietām kā piespiedu izpildes līdzeklis ir paredzēts jau kopš 2003. gada 01. janvāra, pastāvīgu procesuālu regulējumu attiecībā uz to Civilprocesa likums nenoteica vairāk kā 15 gadus, līdz 2018. gada 01. jūlijā stājās spēkā apjomīgi grozījumi, ietverot Civilprocesa likumā atbilstošas tiesību normas. Darba mērķis ir aplūkot grozījumu rezultātā ietvertās tiesību normas, to iespējamās nepilnības un problēmas, ar kurām varētu nākties saskarties praksē. Veicot juridiskās literatūras, prakses un normatīvo aktu analīzi, autore ir izvirzījusi priekšlikumus normatīvo aktu pilnveidei. Darba ietvaros tika salīdzināts Latvijas un Igaunijas regulējums attiecībā uz piespiedu izpildes procesu. Bachelor’s thesis them is “Recovery procedure against intangible things”, which is included as one of the means of enforcement in Civil Procedure Law (in Section 557). In Bachelor’s thesis will be discussed the content and scope of the notion of "intangible thing" by defining the features and characteristics of the intangible things. Research includes questions like Recovery procedure against intangible things as means of enforcing enforcement, its procedural side - seizure, appraisal, and sale. Although Civil Procedure Law has already provided for a permanent procedural framework in respect of which Civil Procedure Law did not provide for more than 15 years as a means of coercive enforcement since 1 January 2003, Civil Procedure Law did not provide for a permanent procedural regulation for more than 15 years, until 1 July 2018, when amendments entered into force including the relevant legal norms in Civil Procedure Law. The aim is to research procedural actions and to express commentary about some legal norms, their possible flaws and problems that might arise in practice. By conducting the analysis of legal literature, practice and normative acts, the author has made proposals for the improvement of normative acts. In this paper the author was compared regulation of the forced enforcement process in Latvia and Estonia will be compared.
