Nepieciešamā aizstāvēšanās

Abstract

Autores izvēlētais temats bakalaura darbam ir nepieciešamā aizstāvēšanās. Šāds temats tika izvēlēts, jo autore uzskata, ka šis apstāklis krimināltiesībās ir ļoti svarīgs, jo ļauj personām aizsargāt savas tiesības un intereses nesaņemot sankciju, kas paredzēta Krimināllikumā, un saredz iespējamību, ka nākotnē būs nepieciešams apstākļa būtības maiņa, jo pasaulei attīstoties, mainās noziegumu veidi pret kuriem personai nepieciešams aizstāvēties. Darbā tiek aplūkots nepieciešamās aizstāvēšanās apstāklis un tā salīdzinājums ar citiem apstākļiem, kas izslēdz kriminālatbildību, Latvijas tiesu prakse saistībā ar nepieciešamo aizstāvēšanos, nepieciešamās aizstāvēšanās izpratne ārvalstīs. Darba mērķis – izpētīt nepieciešamās aizstāvēšanās vēsturisko attīstību; nepieciešamās aizstāvēšanās jēdzienu un tiesīgumu nosacījumus; šī apstākļa izpratni ārvalstīs. The topic chosen by the author for this bachelor thesis is requiered defence. This topic was chosen because the author believes that this circumstance is very important, because it allows the person to defend his or her rights and interests without getting sanctioned, as it is written in the Criminal Law. The circumstances are going to change in the future, because the criminal acts that a person needs to defend against are always changing. The topic of this bachelor thesis is the required defence circumstance and it is comparison with other circumstances which do no involve criminal responsibility, required defence in the Latvian justice system and the understanding of required defence in other countries. The goal of this bachelor thesis – study the hostorical development of required defence, the terminology and the eligibility terms, and the understanding of required defence in other countries.
