Izteikumu ietekme uz nevainīguma prezumpciju

Abstract

Nevainīguma prezumpcija jau vairākus simtus gadu atpazīstama kā viens no būtiskākajiem kriminālprocesa principiem. Neraugoties uz to, izpratnes par tā tvērumu ir dažādas un mainījušās līdzi laikam. 20. gadsimta nogalē nostiprinājusies atziņa, ka nevainīguma prezumpciju spēj aizskārt publiski izteikumi. Tikai nesen veikti pirmie centieni šajā jautājumā radīt vienotu starptautisku regulējumu. Darbā pētīts Eiropas Padomes un Eiropas Savienības regulējums attiecībā uz runas brīvības un nevainīguma prezumpcijas mijiedarbību un to kopīgais un atšķirīgais no Amerikas Savienotajās Valstīs valdošās izpratnes. Tāpat atsevišķa uzmanība pievērsta moderno saziņas līdzekļu radītajiem apdraudējumiem.

Presumption of innocence has been known for several hundreds of years as one of the most fundamental principles of criminal procedure. Despite this fact, the understandings of its scope are different and have developed in time. In the end of 20th century it was established that presumption of innocence can be infringed by public statements. Only recently the first attempts, to create an international regulation on this issue, have been attempted. In this paper the research has been done on the regulations of Council of Europe and European Union on the mentioned issue, as well their common and different from the approach of the United States of America. Also, an individual attention has been paid to the risks caused by modern means of communication.
