Bakalaura darba temats ir “Atbildību pastiprinoša apstākļa - noziedzīga nodarījuma izdarīšana alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošu vielu ietekmē - tiesiskais regulējums un piemērošana.” Bakalaura darba mērķis ir aplūkot atbildību pastiprinoša apstākļa – noziedzīga nodarījuma izdarīšana alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošu vielu ietekmē vēsturisko attīstību, ietekmi uz soda mēru noteikšanu un piemērošanu praksē. Bakalaura darba uzdevumi ir izpētīt atbildību pastiprinoša apstākļa – noziedzīga nodarījuma izdarīšana alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošu vielu ietekmē – nozīmīgumu, nepieciešamību, izpētīt un izvērtēt tiesību zinātnieku viedokļus, analizēt tiesu praksi soda mēra noteikšanā. Darba autore secina, ka Krimināllikuma 48. panta pirmās daļas 12. punktā ietvertais atbildību pastiprinošais apstāklis ir viens no visbiežāk sastopamajiem apstākļiem krimināltiesību praksē, it īpaši lietās saistībā ar vardarbību, zādzību un huligānismu. Izpētot šo atbildību pastiprinoša apstākļa tiesisko regulējumu, autore uzskata, ka tajā pastāv individualizācijas problemātika. Tāpēc autore piedāvā grozījumus Krimināllikumā, ietverot Krimināllikuma 48. pantā atsevišķo daļu ar sīkāku atbildību pastiprinoša apstākļa – noziedzīga nodarījuma izdarīšana alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošu vielu ietekmē – regulējumu, un piemērošanas kartību, kas paredz soda individualizāciju un taisnīga soda apmēra piemērošanu. Darba autore apskata jaunāko tiesu praksi, saistībā ar noziedzīgiem nodarījumiem, kuri izdarīti alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošu vielu ietekmē, un izdara secinājumus par šī atbildību pastiprinošā apstākļa piemērošanu un ietekmi uz soda mēru. The subject of the bachelor's thesis is “Legal framework and application of aggravating circumstance - committing a criminal offence while intoxicated by alcohol, narcotic, psychotropic, toxic or other intoxicating substances”. The aim of the bachelor’s is to study the impact of the aggravating circumstance – committing a criminal offence on the historical development of alcohol, narcotic, psychotropic, toxic or other intoxicating substances - on the imposition and application of punishment measures in practice. The tasks of the bachelor’s work are to investigate the importance of an aggravating circumstance – committing a criminal offence affecting alcohol, narcotics, psychotropic, toxic or other intoxicating substances, to study and evaluate the views of scientists, analyse the case law in determining the punishment measure. The author concludes that the aggravating circumstance of Article 48, first paragraph, point 12 of the Criminal Law is one of the most common circumstances in criminal law practice, particularly in cases of violence, theft and hooliganism. While examining the legal framework for this aggravating circumstance, the author considers that there is a problem of individualization of punishment measure. Therefore, the author proposes amendments to the Criminal Law, including in Article 48 of the Criminal Law, a separate part of the aggravating circumstances – the committing of a criminal offence affecting alcohol, narcotic, psychotropic, toxic or other intoxicating substances – regulation and the application of the rules governing the individualization of the sentence and the application of a fair penalty. The author reviews the latest case-law in relation to criminal offences committed under the influence of alcohol, narcotic, psychotropic, toxic or other intoxicating substances, and draws conclusions on the application and impact on the punishment measure of this aggravating circumstance.
