Abstract
Promocijas darba mērķis ir pārbaudīt hipotēzi, ka laikmetīgas demokrātiskas
valsts tiesiskajai sistēmai jānodrošina sasniegtais informācijas atklātības aizsardzības
līmenis publiskas informācijas pieejamības sakarā, kam savukārt jāatbilst vismaz
vispārīgi atzītam minimumam. Līdz ar to darba ietvaros apskatīti vairāki jautājumi,
tostarp tas, kas uzskatāms par informācijas atklātības aizsardzības līmeĦa minimumu
publiskas informācijas pieejamības sakarā, kādas ir šī minimuma optimizācijas
iespējas, kas uzskatāms par attiecīgā līmeņa samazinājumu, kādu Latvijas tiesiskā
sistēma nosaka informācijas atklātības aizsardzības līmeni publiskas informācijas
pieejamības sakarā, vai ir konstatējama atbilstība starptautisko cilvēktiesību
dokumentu prasībām un vai un kāda tiesiskās sistēmas pilnveide nepieciešama
attiecīgajā aspektā.
The task of the doctoral thesis is to verify the hypothesis that the legal system of contemporary democratic State has to ensure achieved level of protection of freedom of information in respect of accessibility of public information, which, in its turn, has to correspond to at least the generally accepted minimum. Therefore, within the work, there are examined several questions, among them: what is considered to be a minimum level of protection of freedom of information in respect of accessibility of public information; what kinds of possibilities exist for optimising this minimum; what is regard as a decrease of particular level; what level of protection of freedom of information in respect of accessibility of public information is set by the legal system of Latvia; whether the legal system of Latvia corresponds to requirements of international human rights documents and whether and what kind of developments are necessary in respect of this legal system?
