Personas izvertēšana adoptētāja statusam un kļūšana par adoptētāju.

Abstract

Persona ar adopcijas apstiprināšanu iegūst aizgādības tiesības pār bērnu, tādēļ ir jāpārliecinās, ka persona atbilst attiecīgajām prasībām. Darba mērķis ir izpētīt procesu, kādā notiek personas izvērtēšana adoptētāja statusam un kļūšana par adoptētāju. Darba uzdevumi ir izpētīt adopcijas kārtību, analizēt personas izvērtēšanas procesu, iepazīties ar aktuālākajiem adopcijas statistikas datiem Latvijā. Darba rezultātā tiek secināts, ka adopcija tiek īstenota adoptējamā interesēs, tādēļ adoptētāja atbilstība likumā noteiktajām prasībām negarantē personas kļūšanu par adoptētāju. Tiek piedāvāti grozījumi Civillikuma 162. panta pirmajā daļā, 163. panta trešajā daļā, Ministru kabineta noteikumu Nr. 667 23.8. punktā, 25. punktā, 45. punktā un 53. punktā.

With the approval of the adoption person acquires custody rights over the child so the person must correspond to the necessary requirements. The aim is to study the process of assessing a person`s status as an adopter and becoming an adopter. The tasks are to ascertain the adoption procedure, to analyse the process of evaluating the person, to get acquainted with the most up-to-date adoption statistics in Latvia. It is concluded that in adoption the interests of the adoptee prevail over the interests of the adopter so the compliance with the law of the adopter does not guarantee the person becoming an adopter. Amendments are proposed to be made in the first paragraph of Article 162, the third paragraph of Article 163 of the Civil Law of Latvia and Cabinet Regulation no. 667 Articles 23.8., 25., 45., 53.
