Literāra darba autorības koncepts: kontekstuālie aspekti

Abstract

Balstoties uz autorības izpratni, kas autorību skaidro kā autora tiesības tikt atzītam par darba autoru - fizisko personu, kuras radošās darbības rezultātā radīts literārais darbs, Ineses Paklones promocijas darbā Literāra darba autorības koncepts: kontekstuālie aspekti kritiski izvērtēts literāra darba, autorības, autora un līdzautoru jēdzienu saturs saistībā ar to atpoguļojumu Latvijas Republikas Autortiesību likumā, tā interpretācijās no juristu viedokļa, lietojumu latviešu valodā un literatūras zinātnē. Iezīmēts autorības iegūšanas process un autorības fiksācija ar savu vārdu vai pseidonīmu, kā arī autorības zaudēšana, gan apzināti atsakoties no autorības, - darbu publicējot anonīmi, kļūstot par slēpto jeb rēgu rakstnieku vai radot literāru mistifikāciju, gan piedzīvojot darba plaģiātu. Analizēta autora saistība ar savu darbu un autora atribūcija dažādos kontekstos - oriģināldarbos, atvasinātajos darbos (adaptācijā, libretā, dramatizējumā, scenārijā; tulkojumā; anotācijā, recenzijā, referātā; parodijā;) un saliktajos darbos (krājumos un datu bāzēs), dodot ieskatu atribūcijas mehānismā un pievēršo uzmanību darba valodas un ārpusvalodisko faktoru lomai atribūcijā. Salīdzināts līdzautorības koncepts darbos, kur autoru devums nav nošķirams, un darbos, kur autoru devums ir nošķirams; aplūkota līdzautorība/autorība folkloras vārdiskajos darbos; atklātas šķietamo līdzautoru (redaktora, cenzora, lasītāja) attiecības ar darbu un tā autoru. Pētījuma rezultātā izveidota ar autorību saistīto jēdzienu īsa skaidrojoša vārdnīca, kas ievietota pielikumā. Promocijas darbā izmantoti latviešu rakstnieku uzskati par savu darbu, kā arī latviešu autoru literārie darbi, parādot tos jaunā pētījumu rakursā.

Based on an understanding of authorship that defines authorship as the rights of an author to be recognised as the author of a work – a physical person whose labours have resulted in the creation of a literary work, Inese Paklone’s Ph. D. thesis “The Concept of Authorship in a Literary Work: Contextual Aspects” critically evaluates the concepts of a literary work, authorship, the author and the co-author as reflected in the Copyright Law of the Republic of Latvia and the understanding of these concepts in the Latvian language and in the context of literary scholarship. Themes treated focus on the process of the acquisition of authorship and recording it with the author's real name or pseudonym and the loss of authorship due to the conscious abrogation of such rights by means of anonymous publication; the concept of the ghost-writer; the creation of a literary mystification, and the experience of plagiarism. The connection between the author and his or her work, the attribution of authorship in an original work, derivative works (adaptations, libretti, dramatizations, scripts; translations; annotations, reviews, lectures; parodies) and composite works (collections and databases) are covered, offering insights into the mechanisms of attribution as well as the role of language in the process. Comparisons and contrasts are drawn between examples of concepts of co-authorship in works in which the individual authors are indistinguishable and in those in which they can be distinguished. The study also covers the collective authorship in folklore and the relationship of ostensible co-authors (editors, censors, readers) to literary work. A glossary of terms which are used in relation to authorship is compiled and appended. The paper draws on reflections on their work by Latvian writers as well as works by Latvian authors, providing a fresh way of considering them.
