dc.description.abstract | Starptautisko ekspertu (MONEYVAL) 2018. gada neapmierinošs vērtējums par Latvijas valsts spējām nepieļaut savas finanšu sistēmas izmantošanu noziedzīgi iegūtu līdzekļu legalizēšanai, kā arī potenciālie draudi tikt iekļautai “pelēkajā sarakstā”, rezultējās valdības lēmumā par finanšu sektora “kapitālo remontu”. Veiktās izmaiņas, t.sk. normatīvajā regulējumā, tika atzinīgi novērtētas no starptautisko ekspertu puses, tomēr šobrīd, pētot notikušo pārmaiņu samērīgumu un ietekmi tiesību zinātnieki, finansisti un ekonomisti nonāk pie secinājumiem, ka veicot “kapitālo remontu” esam pārcentušies. Praksē tas izpaužas virknē problēmu, piemērām, pārspīlēti detalizētā regulējumā, kas pēc būtības ietekmē ikkatru kredītiestāžu klientu, neatkarīgi no tam piemītošā riska. Darba ietvaros tiek piedāvāti identificēto problēmu risinājumi. dc.description.abstract | The unsatisfactory assessment of international experts (MONEYVAL) in 2018 about the ability of Latvia to prevent the use of its financial system for money laundering, as well as the potential threat of being included in the “gray list”, resulted in the government's decision to “overhaul” the financial sector. The changes made, including those in the regulatory framework were welcomed by the international experts. However, now, when studying the proportionality and impact of the changes made, legal scientists, financiers and economists come to the conclusion that we have overdone. In practice, this manifests itself in a number of problems, for example as overly detailed regulation, which essentially affects every customer of a credit institution, regardless of the risk involved.
