Būvatļaujas pārreģistrācija

Abstract

Viens no būvniecības tiesiskā regulējuma maiņas iemesliem 2014. gadā bija radīt skaidri definētu administratīvo procesu būvniecībā, kas būtu skaidri izprotams no normatīvo aktu viedokļa. Bakalaura darbs ir veltīts izpētei, vai likumdevējam ir izdevies realizēt ieceri harmonizēt būvniecības tiesisko regulējumu ar administratīvā procesa tiesisko regulējumu attiecībā uz būvatļaujas pārreģistrācijas gadījumiem. Bakalaura darba rezultātā tiek secināts, ka būvniecības tiesiskajā regulējumā atrodamas pretrunas ar administratīvā procesa regulējumu, un sniegti priekšlikumi, kādus grozījumus veikt būvniecības tiesiskā regulējuma normatīvajos aktos, lai radītu vienotu izpratni par normu piemērošanu.

One of the reasons for the changes of the building industry legal network in 2014 was to create a clearly defined administrative procedure for building industry, distinctly understandable from the point of view of laws and regulations. The bachelor's thesis are devoted to the research on real succeed of harmonization between building industry legal framework and administrative procedure legal framework, particularly focusing to the cases on re- registration of building permits. As a result of the bachelor's thesis, it is concluded that the building industry legal framework contains contradictions with the administrative procedure legal framework, and the proposals on the amendments of the laws and regulations within building industry regulatory framework had been prepared, in order to create a common understanding of legal rules application.
