Maģistra darba tēma ir “Atsevišķi mantojuma lietas vešanas aspekti”. Mantojuma lietas vešanas regulējums ir iekļauts Civillikumā, Notariāta likumā, Ministru kabineta 2008.gada 4.augusta noteikumos Nr.618., kā arī citos normatīvajos tiesību aktos, kas piemērojami vedot mantojuma lietu Latvijā. Darba ietvaros apskatīta Eiropas Parlamenta un Padomes Regula (ES) Nr.650/2012, lai gūtu ieskatu tajā, kā vedama pārrobežu mantojuma lieta. Maģistra darba ietvaros tiek aplūkota mantojuma lietu vešanas vēsturiskā attīstība, tai skaitā notariāta vēsturiskā attīstība, kā arī Latvijas normatīvo tiesību aktu regulējums salīdzināts ar ārvalsts normatīvajiem tiesību aktiem, aplūkojot mantojuma lietu vešanas procesu. Darba galvenais mērķis ir izpētīt mantojuma lietu vešanas procesu, zvērināta notāra funkcijas un pilnvaras vedot mantojuma lietas. Viens no galvenajiem maģistra darba uzdevumiem ir apskatīt problēmjautājumus, ar kuriem zvērinātam notāram nākas saskarties vedot mantojuma lietu un sniegt ieteikumus, priekšlikumus šo problēmjautājumu atrisināšanai. Darba rezultātā autore ir nonākusi pie secinājumiem par mantojuma lietu vešanas procesa būtību, atklājusi problēmas, kurām piedāvājusi risinājumus šo problēmu novēršanai. The topic of the master's thesis is "Certain aspects of inheritance proceedings". The inheritance litigation is included in the Civil Law, the Notary Law, Cabinet Regulation No. 618 of 4th of August 2008, as well as in other regulatory enactments applicable to the conduct of an inheritance case in Latvia. Additionally, Regulation (EU) No 650/2012 of the European Parliament and of the Council is covered in the work to further advance perception of the conduct of cross-border inheritance cases. Within the framework of the Master's thesis, the historical development of inheritance cases will be observed, including the historical development of notaries, as well as the regulation of Latvian regulatory enactments will be compared with foreign regulatory enactments when considering the inheritance case process. The main goal of the work is to study the process of inheritance cases, the functions and powers of a sworn notary in inheritance cases. One of the main tasks of the master's thesis is to look at problematic issues that a sworn notary has to face when conducting an inheritance case and to provide recommendations and proposals for solving these problematic issues. As a result of the work, the author has come to conclusions about the essence of the process of conducting inheritance cases, revealed problems for which she has offered solutions to eliminate these problems.
