Mūsdienās skaidras naudas apritei ir noteikti ne mazums vien ierobežojumu, un pēc ekspertu domām to skaits arvien turpinās pieaugt. Lai arī šāda valsts rīcība nenoliedzami ir vērsta uz sabiedrības labklājības un tiesiskās drošības veicināšanu, skaidras naudas aprites ierobežošana vienlaikus var radīt arī nepamatotu personas Satversmē ietverto pamattiesību aizskārumu. Apzinot pastāvošo problemātiku, maģistra darbs “Skaidra nauda kā īpašuma tiesību objekts un tās aprites ierobežojumi konstitucionālo tiesību jomā” ir izstrādāts ar mērķi izzināt skaidras naudas konstitucionāli tiesisko statusu un skaidras naudas apritei noteikto ierobežojumu atbilstību pamattiesību ierobežojuma konstitucionalitātes testa kritērijiem, nodrošinot demokrātiski tiesiskas valsts pamatvērtību īstenošanu un aizsardzību. There are many restrictions imposed on the cash circulation nowadays, and in the opinion of the experts, the number will continue to grow. Although such action is undeniably aimed at promoting well-being of society and legal security, limiting the circulation of cash at the same time may also lead to an unjustified violation of the fundamental rights of the person. In identifying existing issues, the Master's “Cash as an object of property rights and restrictions on its circulation in the field of constitutional law” has been developed to clarify the constitutional legal status of cash and compliance with the criteria for the constitutionality test of the fundamental rights restriction, ensuring the implementation of the fundamental values of a democratically legal state and protection.
