Nelikumīgu darbību ar fiziskās personas datiem krimināltiesiskie aspekti

Abstract

Maģistra darba “Nelikumīgu darbību ar fiziskās personas datiem krimināltiesiskie aspekti” ietvaros darba autore ir pētījusi personas datu kā privātās dzīves neaizskaramības sastāvdaļas krimināltiesisko aizsardzību, pievēršot uzmanību personas datu jēdziena vēsturiskajai attīstībai. Autores ieskatā maģistra darba tēma ieņem būtisku lomu šī brīža juridiskajās aktualitātēs visā pasaulē, ņemot vērā tehnoloģiju straujo attīstību un daudzu citu nozaru pielāgošanu tehnoloģiju attīstībai, personas datu apstrāde ir sasniegusi neaptveramu apjomu un personas datu izmantošanas iespējas, kā rezultātā ir nepieciešams izstrādāt tiesību aktus, ar kuriem tiek noteikts datu ievākšanas un apstrādes modelis, kā arī izstrādāt tiesību normas, kas nosaka atbildību par šo tiesību aktu neievērošanu. Maģistra darba ietvaros autore veic ārvalstu un nacionālā normatīvā regulējuma salīdzināšanu, nosakot kopīgās un atšķirīgās tiesību normu iezīmes, izvērtējot nepieciešamību pilnveidot nacionālo normatīvo regulējumu attiecībā uz kriminālatbildību personas datu jomā. Lai maģistra darba pētījums būtu pēc iespējas pilnvērtīgāks, autore veica Eiropas Cilvēktiesību tiesas un Eiropas Savienības tiesas judikatūras personas datu aizsardzības jomā analīzi. Maģistra darba mērķis ir izvērtēt, vai spēka esošais nacionālais normatīvais regulējums, kas nosaka kriminālatbildību par nelikumīgām darbībām ar fiziskās personas datiem, ir pilnvērtīgs un nodrošina nelikumīgu darbību ar fizisko personu datu novēršanu atbilstoši personas datu jomas attīstības tendencēm.

As part of the Master thesis “Criminal aspects of unlawful activities with personal data”, the author has studied the criminal protection of personal data as part of privacy, focusing on the historical development of the concept of personal data. In the author’s view, the subject of the Master thesis plays an important role in the current legal developments around the world, taking into account the rapid development of technology and the adaptation of many technological developments in other sectors, the processing of personal data has reached an inconceivable extent and the potential for use of personal data, which requires the development of legislation establishing a model for collecting and processing data, as well as the development of legal provisions governing the responsibility for non-compliance with this legislation. Throughout this Master thesis comparison between foreign and national regulatory frameworks is made, identifying common and differing legal features, assessing the need to improve the national regulatory framework for criminal liability in the field of personal data. In order to make the Master thesis as complete as possible, the author has analysed the case law of the European Court of Human Rights and European Court of Justice in the field of personal data protection. The aim of the Master thesis is to assess whether the existing national regulatory framework, which criminalises unlawful activities with personal data, is effective as possible according to personal data development and ensures the prevention of unlawful activities with personal data.
