Prokurora loma pirmstiesas procesa izmeklēšanā

Abstract

Pirmstiesas izmeklēšana kvalitāte Latvijā tiek vērtēta kritiski, līdz ar to prokurora lomas stiprināšana var uzlabot un padarīt efektīvāku attiecīgo posmu kopumā. Minētās problēmas kontekstā darba mērķis ir rast risinājumus prokurora lomas paplašināšanai pirmstiesas procesa izmeklēšanā. Lai sasniegtu šo mērķi autore izpēta un analizē prokurora atbildības aspektus pirmstiesas procesa izmeklēšanā Latvijā un ārvalstīs, veicot salīdzinošo izpēti. Pētījuma rezultātā tiek sniegti priekšlikumi attiecībā uz normatīvā regulējuma pilnveidi atsevišķos jautājumos un autores redzējums par prokuratūras iesaisti pirmstiesas procesa izmeklēšanā kopumā.

The quality of pre-trial investigation in Latvia is assessed critically, thus strengthening the role of the prosecutor can improve and enhance the effectiveness of the stage in general. In the context of this problem, the aim of the work is to find a solution to expand the role of the prosecutor in the pre-trial investigation proceedings. In order to achieve this goal, the author researches and analyzes the aspects of the prosecutor's responsibility in the pre-trial investigation process in Latvia and abroad by conducting a comparative research. As a result of the research, proposals are provided regarding the regulatory framework to improve certain issues and the author's vision on the involvement of the prosecutor's office in the pre-trial investigation process in general.
