Abstract

Maģistra darbs “Rīgas vēsturiskā centra telpiskās plānošanas tiesiskie aspekti” ir balstīts uz autores profesionālo pieredzi jautājumos, kas saistīti ar attīstības plānošanu Rīgas vēsturiskā centra teritorijā, t.sk. teritorijas plānojuma izstrādē un tā piemērošanā, tiesību normu interpretācijā, tostarp, līdzdalību atbildes raksta sagatavošanā Satversmes tiesai tiesvedībā par pašvaldības noteikto ierobežojumu spēļu zāļu ierīkošanai atbilstību augstāka juridiskā spēka normai. Pētījuma aktualitāti pamato grozījumi Rīgas vēsturiskā centra saglabāšanas un aizsardzības likumā, normatīvā akta izmaiņas skatot valsts teritorijas attīstības plānošanas sistēmas ietvarā un kopsakarā ar uzsāktajiem attīstības plānošanas procesiem Rīgas pilsētā. Pētījuma ietvaros veikts Rīgas vēsturiskā centra telpiskās plānošanas tiesiskā regulējuma izvērtējums, analizēts spēkā esošā Rīgas vēsturiskā centra un tā aizsardzības zonas teritorijas plānojuma statuss speciālo tiesību normu ietvarā un sniegts piemērošanas problemātikas izvērtējums. Darba rezultāts ir ieteikumi un rekomendācijas Rīgas vēsturiskā centra integrētas telpiskās plānošanas sistēmas pilnveidošanai un ierosinājumi grozījumiem spēkā esošajā normatīvajā regulējumā.

The master's thesis “Legal Aspects of Spatial Planning of the Historic Centre of Riga” is based on the author's professional experience in issues related to development planning in the territory of the Historic Centre of Riga, incl. in the development of the spatial plan and its application, in the interpretation of legal norms, including participation in the preparation of a written reply to the Constitutional Court in legal proceedings regarding the compliance of the restrictions established by the local government for the installation of gaming halls with a norm of higher legal force. The topicality of the research is substantiated by the amendments to the Law on the Preservation and Protection of the Historic Centre of Riga, considering the changes in the regulatory enactment within the framework of the national territorial development planning system and in connection with the initiated development planning processes in the city of Riga. Within the framework of the research, the evaluation of the legal regulation of spatial planning of the Historic Centre of Riga has been performed, the status of the valid spatial plan of the Historic Centre of Riga and its protection zone within the framework of special legal norms has been analyzed and the problem of application has been assessed. The result of the work is suggestions and recommendations for the improvement of the integrated spatial planning system of the Historic Centre of Riga and suggestions for amendments to the existing regulatory framework.
