Zemes piespiedu noma.

Abstract

Bakalaura darbā autore apskata tēmu – zemes piespiedu noma. Tēmas ietvarā tiek apskatīts, salīdzināts un analizēts zemes piespiedu nomas regulējums un tiesu prakse Latvijā no 1990. gada līdz 2021. gada 30. novembrim. Kā arī analizēta novitāte, proti, grozījumi normatīvajā regulējumā, kas paredz vienotu piespiedu nomas maksu un šo attiecību izbeigšanu – dalīta īpašuma apvienošanu vienā. Darbā tiek aprakstīti tādi jautājumi kā, kas ir piespiedu nomas attiecības, kas ir puses šajās attiecībās, kāda loma ir dzīvojamās mājas pārvaldniekam šajās attiecībās, vai dzīvojamās mājas pārvaldniekam ir obligāts pienākums segt nomas maksu, kā noteikt nomas maksu, vai 2021. gada novitāte normatīvajā regulējumā ir samērīga un taisnīga attiecībā pret piespiedu nomas attiecībās iesaistītajām pusēm, atbildība zemes piespiedu nomas attiecībās. Bakalaura darba mērķis ir veikt 2021. gada novitātes normatīvajā regulējumā analīzi kopsakarībā ar iepriekš norādītajiem jautājumiem.

The bachelor's thesis examines the topic of compulsory land lease. Within the framework of the topic, the regulation of compulsory land lease and the case law in Latvia from 1990 to November 30, 2021 is reviewed, compared and analyzed. Also, a novelty has been analyzed, namely, the amendments to the regulatory framework, which provide for a single compulsory rent and termination of this relationship - merging of shared property into one. The paper describes issues such as the relationship of compulsory land lease, parties to this relationship, the role of the residential house manager in this relationship, whether the residential house manager is obliged to cover the rental fee, how to set the rent, is the 2021 novelty in the regulatory framework proportionate and fair to the parties involved in the compulsory lease relationship, the liability in the compulsory land lease relationship. The aim of the bachelor's thesis is to perform an analysis of the novelty in the regulatory framework of 2021 in connection with the above issues.
