Sabiedrība nepārtraukti atrodas attīstības stadijā, kas arī ietekmē noziedzīgās pasaules attīstību, līdz ar to smagu noziegumu atklāšana un izmeklēšana ir būtiski apgrūtināta. Lai ar to cīnītos, Kriminālprocesa 11.nodaļā noteiktas speciālās izmeklēšanas darbības. Bakalaura darba ietvaros darba autore, atbilstoši bakalaura darba mērķim, ir veikusi vispārīgu visu Kriminālprocesa likumā paredzēto speciālo izmeklēšanas darbību vēsturiskās attīstības un veikšanas noteikumu pētniecību. Darbā padziļināta pētniecība veltīta tieši vienai no speciālajām izmeklēšanas darbībām – speciālā izmeklēšanas eksperimenta veikšanas noteikumiem un problemātikai, kas sasitīta ar personu provocēšanu. Kā arī Valsts policijas darbiniekiem, ar aptaujas palīdzību, tiek lūgts sniegt atbildes uz jautājumiem, lai noskaidrotu vai un ar kādām problēmām nākas saskarties veicot speciālo izmeklēšanas eksperimentu kriminālprocesa laikā. Darba rezultātā autore konstatē nepilnības tiesību normu regulējumā un ierosina veikt grozījumus pastāvošajā normatīvajā regulējumā, lai tādējādi nodrošinātu Kriminālprocesa likuma pantu savstarpēju vienotību un novērstu nevienveidīgas un tiesiski nekorektas prakses veidošanos. Society is constantly evolving, which is also affecting the development of the world of crime, making the detection and investigation of serious crime more difficult. In order to combat this, special investigative actions have been established in Chapter 11 of the Criminal Procedure Law. Within the framework of the bachelor's thesis, the author, in accordance with the aims of the Bachelor's thesis, has done a general research of the historical development and rules of all special investigative activities provided in the Criminal Procedure Law. In-depth research is devoted to one of the special investigative activities - the rules of conducting a special investigative experiment and the problems associated with the provocation of persons. Also, twenty too State Police investigators, with the help of a survey, have been asked to provide answers to in order to find out whether they have any problems during the process of special investigative experiment. Resulting from the thesis the author identifies shortcomings in the regulation of legal norms and proposes amendments to the existing regulatory framework in order to ensure the mutual unity of the norms of the Criminal Procedure Law and to prevent the formation of an inconsistent and legally incorrect practice.
