Bakalaura darbā tiek apskatīta kasācijas instances būtība un regulējums Kriminālprocesa likumā un citu valstu kriminālprocesuālajā regulējumā, kā arī analizēti tiesu nolēmumi, kurus ir iespējams un kurus nav iespējams pārsūdzēt kasācijas kārtībā, to ierobežojumu pamatojums, vērtēti Senāta un citi ierosinājumi iespējamiem grozījumiem. Darba mērķis ir izpētīt un izdarīt secinājumus par pieejamību kasācijas instances tiesai kriminālprocesā, tās ierobežojumus un iespējamos grozījumus Kriminālprocesa likumā. Darba uzdevumi ir izpētīt kasācijas instances tiesas būtību kriminālprocesā un tās vēsturisko attīstību Latvijā, analizēt atsevišķu nolēmumu pārsūdzības pieejamības ierobežošanas iemeslus, tostarp apskatot likumdošanas materiālus, kā arī salīdzināt kriminālprocesuālo regulējumu ārvalstīs. Darba rezultātā tiek secināts, ka likumdevējs drīkst ierobežot pieejamību kasācijas instances tiesai kriminālprocesā, taču šiem ierobežojumiem ir jābūt pamatotiem, balstītiem uz vienotiem kritērijiem, lai netiktu pārkāptas tiesības uz taisnīgu tiesu. Autore izvirza priekšlikumus grozījumiem Kriminālprocesa likuma 620. un 631. pantā, kā arī ierosināti iespējamie apsvērumi, kas likumdevējam jāizvērtē, lemjot par pārsūdzības ierobežošanu konkrētā procesā pieņemtam tiesas nolēmumam. Bachelor thesis reviews the essence and regulation of the court of cassation in the Criminal Procedure Law of Republic of Latvia and in the criminal procedure regulation of other countries, as well as it analyzes court rulings which can be appealed and which cannot be appealed in cassation, justification of their restrictions, the Senate and other proposals for possible amendments have been evaluated. The aim of this thesis is to review and draw conclusions about the accessibility of the court of cassation instance in criminal proceedings, its restrictions and amendments to the Criminal Procedure Law of Latvia. The objectives of this thesis are to explore the essence of the court of cassation instance in criminal proceedings and its historical development in Latvia, to analyze the reasons for restricting the accessibility of appeal against certain decisions, including studying legislative materials, and to compare the regulation abroad. As a result of the research, it is concluded that the legislator may restrict access to the court of cassation instance in criminal proceedings, but these restrictions must be justified, based on common criteria, without violating the right to a fair trial. The author puts forward proposals for amendments to Articles 620 and 631 of the Criminal Procedure Law of Latvia, as well as possible considerations the legislator should consider when deciding on the limitation of an appeal against a court ruling made in a particular proceeding.
