Ministru kabineta rīcība ārkārtējās situācijas apstākļos

Abstract

Bakalaura darbā “Ministru kabineta rīcība ārkārtējās situācijas apstākļos” tiek apskatīts mūsdienu ārkārtējās situācijas institūts, ņemot vērā tā aktīvo izmantošanu pēdējos gados un teorētisko pētījumu trūkumu par attiecīgo jautājumu. Pētījuma mērķis ir izpētīt īpaša tiesiskā režīma mehānisma vēsturisko ģenēzi un attīstību, analizēt tā saturu, kā arī izpētīt ārkārtējās situācijas mehānismu Latvijā kopsakarā ar Ministru kabineta kā augstākā izpildvaras orgāna lomu mehānisma darbībā. Bakalaura darba m ir šādi uzdevumi: definēt īpašu tiesisko režīmu, analizējot šī mehānisma vēsturisko ģenēzi, attīstību un dabu; analizēt juridiskajā literatūrā izteiktos viedokļus par īpašā tiesiskā režīma dabu un saturu; apzināt Latvijas Republikā spēkā esošu regulējumu, tiesu praksi, kā arī zinātnes atziņas, kas attiecas uz ārkārtējo situāciju kā īpašu tiesisko režīmu; izpētīt ārkārtējās situācijas piemērošanas praksi un analizēt problemātiku, kā arī izcelt Ministru kabineta lomu ārkārtējās situācijas apstākļos. Autors secina, ka īpašs tiesiskais režīms ir izņēmuma pagaidu līdzeklis ārkārtējo apdraudēju pārvarēšanai. Tas ir nepieciešams tikai demokrātiskās valstīs. Ar lēmumu par īpaša tiesiskā režīma izsludināšanu izpildvaras augstākais orgāns iegūst ārkārtējās pilnvaras. Attiecīgais lēmums kā Romas republikas laikā, tā arī mūsdienās Latvijas Republikā ir politisks lēmums, ko pieņem ministru kabinets. Ārkārtējā situācija ir izsludināma ar kombinētu tiesību aktu, kurš satur politisko lēmumu izsludināt īpašo režīmu, norādījumiem valsts un pašvaldību institūcijām un privātpersonu tiesību ierobežojumiem.

In the bachelor's thesis “Action of the Cabinet of Ministers in the Conditions of an Emergency Situation”, the Institute of Modern Emergency Situations is considered, taking into account its active use in recent years and the lack of theoretical research on the relevant issue. The aim of the study is to study the historical genesis and development of the special legal regime mechanism, to analyse its content, as well as to study the mechanism of the emergency situation in Latvia in connection with the role of the Cabinet of Ministers as the highest executive body. The tasks of the bachelor's thesis are as follows: to define a special legal regime by analysing the historical genesis, development and nature of this mechanism; to analyse the opinions expressed in the legal literature regarding the nature and content of the special legal regime; to identify the regulations in force in the Republic of Latvia, court practice, as well as scientific findings that relate to an emergency situation as a special legal regime; to study the practice of applying the emergency situation and to analyse the issues, as well as to highlight the role of the Cabinet of Ministers in the circumstances of the emergency situation. The author concludes that a special legal regime is an exceptional temporary means of overcoming extreme threats, which is only necessary in democracies. By a decision to promulgate a special legal regime, the executive branch acquires extraordinary powers. The relevant decision, both during the Roman Republic and in the Republic of Latvia nowadays, is a political decision made by the highest body of the executive power. The state of emergency must be declared by a combined legal act, which contains a political decision to promulgate the special regime, instructions to state and local government institutions and restrictions on the rights of individuals.
